County Clerk Droxel has tucked away in the office vault cabinet the financial state- ments of the campaign filed with him by those who were candfdates, or at least thought they were, at th and in some fnstances these tales of costly dlsappointments. @ates had to make such flling wiihin ten days after the election and the treasurers of the committees within twenty days. The time being expired, It was supposed that all had complied, but thls morning in running through the bunch there was dis- ©oovered an important omission which ralses an {nteresting question who can bear to discuss the affairs of the dead. Boction 4 of article ITT of the corrupt Practices act states that “‘every person who ahall be a candidate for election ‘to the office of representative in the congress of the United States or to any office which wunder the laws of the constitution of this state fs to be filled by popular election @xcept township, precinct or school distrl officers or village trustees, shall within tzh b days after the election held to fill suy office, make out a statement In writing filo the same with the clerk of the coupty in which he resides and make out and file ' doplicate thereof with the board of pff- wers, it any, empowered by law to isjue the certificate of elaction to such office, | Buch statement shall set forth in detall each and all sums of money and ofher things of value contributed, disbursed, ex- pended or promised by him and (to the best of his knowledge and belief) by any other person or persons by his procurement in his behalt.” Penalty is Heavy Fine. The section immediately following reads: “Any person failing to comply with the third section or the fourth section of this act shall be lable to a fine not exceed- ing 1,000, to be recovered with costs, brought in the name of the state by tho attorney general or by the county attor- ney of the county of the candidate's resi- dence, the amount of said fine to be fixed within such limit by the jury, and to be paid into the school fund of sald county.” Notwithstanding these provisions of the statutes, there s not in the filing box any statement from the late David Henry Mer- cer nor from any of the eminent counsel- ors who spoke and acted for him during his campaign for another term In con- gross. And eince thése learned jurists must certainly have known of this law, there {a at the court house the inference that David Henry must have been, as some insinuated at the time, really a resident ot some other section than Douglas county during the late campaign and prior thereto. The law question that arises is as to ‘whether David Henry will have to file at all, since Washington is in a dfetrict, not & county, and Minneapolis is in a state whose laws may not be so exacting as s there been any filing here By the republican congressional commit- tee, but that may be because the treasurer 18 an evanescent being whose location ®eems as hard to learn as that of the con- gressman himself. Burkley's report shows contributions of $100 from John A, Creighton, $100 from ‘W. 8. Poppleton and $200 trom Hitcheock, or & total of $400, as against a total expend- dture of $395.90 for printing, stenographers’ hire and secretary’'s meeds. Secretary Cosgrove reports that his larg- est expenditure was $42 for postage and the next largest $15 for Hebrew circulars, pald Phillp Stein. The other disbursements st were in sums of §1 to §5 for turnish- ing “lists of voters.” Bernard McCaffery, soclalist nominee, re- ports that his efpenses amounted to “not one red cent.” A. W, Jefferis, republican candidate for county attorney, reports that he gave the central committee $50 and spent enough more for printing cards and advertising to make his total $148.50. J. P. L. to Recover Loss by Texas Fever, In the United States court the case of the Quitman Land and Cattle = company against John L. Carey s on trial. This is a suit for $4,680 damages arising from the death of a number of cattle owned by the plaintiffs. It is alleged that the plaintifts, residents of Missourl, purchased from the defendant and C. J. Hysham of Omaha 304 head of cattle from Texas, which the de- fendant and Hysham said were not contam- inated with Texas fever, but which dld communicate the disease to a mumber of northern cattle which were placed on pas- ture with them, 80 that sixty-elght head of the northern cattle and two head of the Texans died, with a damage to the others amounting to the sum sped for. The answer of the defendant is to the effect. that he did not sell the cattle to the plaintifts, thele stock before it reached St. Joseph, where the sale was made, and the stock sold to the company was the property of Hysham and not of both; that if any dam- age resulted to the stock of plaintiffs it was due to their own carelessness, as they should have known that immune Texas cat- tle might communicate the dise to northern stock. The contempt case against the Union Pa- cific strikers, which was to have been called morning, was continued by Judge Munger until Monday, at which time he will an- nounce further orders. When the time for hearing came the court room was filled by the men under attach- ment and their friends, all seemingly anx- fous to have the hearing proceed.
