CIVIL SUIT IS BEGUN FOR MISSING FUNDS Federal Authorities Assert that Gove ernment Money is Lost Through Davis' Disobedience and Neglect of Duty. After having euccessfully passed through a criminal prosecution J. Albert Davis, the young man who was in charge of Station B of the Omaba postoffice at the time it was robbed in January, 1900, is to be sued for the amount of money taken rom the station safe at that time, and his bondsman, the Natfonal Surety company, is to be called upon to make the amount good. Thie course was determined upon by the Qistrict attorney of the United States some timo ago and papers were flled yester- day. In tho petition, which Is brought in the name of the United States of America, it is stated that Davis was placed in charge of the statfon and while {n that capacity was charged with the custody of the funds of the ofiice; that owing to his negleot of duty and lack of diligenco the funds wero lost to the government. The robbery of Station B took place the day after Richard Phoenix, the man in charge of the station for several years, had been charged with embezzling postoffice funds and had admitted the fact. Phoenix later in the day mortgaged his household turniture for the amount of his embezzle- ment and turned the funds over to the postmaster. The postmaster placed thie money in charge of Davis, who was called from the central office to relleve Phoenix. | Davis was instructed to send the money to the central office later in the day, but in- stead of doing this placed it in the eafe. | The next morning the money had disap- | peared and the arrest of Davis followed. At his trial at the November term of the tederal court he was acquitted, it being shown that Phoenix, the embezzling clerk, | had knowledge that the monmey was in the safe and that access to the office could be gained through a basement window. Postmaster Crow and Inspector Sinclair visited the station’ and examined the books, They found that there should be on hand $203 of this fund. An examination of sate showed no money except some belonging to the postal funds. Phoenix was charged with embezzling the money and coufessed to the shorisge, saying that he had uscd the money in his private business, but nad oxpected to return it before the shortage was discovered, Phoenix was not then put under arrest, but was permitted to Ko after the mouey, which ha promised to re- turn. He mortgaged his household furni- ture for the amount of the shortage and about noon returned with the cash, which he gave to the postmaster. He w then arrested. In the morning when the shortage was discovered the postmaster asked that & clerk bo sent from the postofce to take Phoenix’s place and Albert Davis was as- signed to the work. He arrived just be- fore the money was paid to the postmaster by Phoenix and was placed in charge. In- stead of taking the money to the postoMce himself, when he recelved it from Phosnix, Postmaster Crow gave it to Davis and re- quested him to make out a remittance theet and send it with the cash to the office before the close of business. Davis failed to do this, asserting that he was #0 busy with his new duties that he had 10 time in which to make out the remittance sheet, At the hour of closing he (ele- phoned to the central office and told them that he had fafled to tramsmit the money and asked tho officials what he should do with it. Assistant Postmaster Woolard instructed him to place the funds tn the afe and send them down the first thing in the morning and to go to the office ia the morning and walt until he was relioved by Charles A. Crow, the regular rellef. Phoenix s Consulted, After ho had placed the money in the safo and thrown the combination, Davis remembered that he did not know the combination, so that when he opened the office In the morning, while waiting for Crow, he would have ueither stamps nor funds with which to transact business. He, therofore, went to the central posi- office and sent a messenger to Rlohard Phoenix asking him to send him the com- bluation of the safe. This Phoenix re fused to do, but sald that he would glive it to Davis It he would call. Davis then went to the home of Phoenix and there told him that he wanted the combination because he had locked the sate and could not get material in the morning without it. He also told him that the ‘unds which should have been sent to the central office that night were in the safe and tlLat he was expected to send them down the first thing in the morning. According to the testimony In the trial of Davis he then went to South Omaha, where he spent the evening, returning home about midnight. The next morning the funds were gone from the safe. The safe was locked, it being necessary to work the combination to open it. When the door was opened and the drawers found empty an examina- tion was made and it was found that the burglar had opened the drawers with a stove wrench, which was usually attached to the stove In the rear of the room. It had been usual for Phoenix to leave the keys in the drawers when locking the safe, but Davis had removed them. As 800m as the robbery was reported to the central office Davis was arrested apd an attempt made to get a contession from him to the effect that he had taken the money. He mafntained his innocence, but was indicted. The bill against Phoenix, who at that time was out on bond signed by H. B. Irey, under charge of embezzle- ment, was ignored and Phoenix was dis- charged. At the trial of the Davis case it was shown that Phoenix was the only man who knew the combination of the safe, who also knew that the money was in the safe; that a window leading to the basement, through which coal wop delty- ered to the office, was open, or only held shut by a bent nall, which would yield to pressure, and that all matters relating to the condition of the bullding were known to Phoenlx, he being the only man who could know that once In the basement nothing was in the way of entrance to the postofice, as the door from the basement to the room above was never locked, Ensy In the face of all of this circumnstantial evidence Phoerilx was never offiolally charged with the crime. Postoffice In- spectors and the postmaster asserted that this would be foolish, as Mrs. Phoenix bad accounted to them for Phoenix during all hours ‘of the night, In the progccution of Phoealx on tha charge of embezzlement a peculiar condl- tion existed. Phoenix had pleaded guilty; had made a written confession; an indict- ment was prepared by District Attorney Summers and presented to the grand jury. Phoenix was a unlon veteran and had been for years one of the steadfast members of the Grand Army of the Republic.
