Fremont Benjamin, the attorney who has attacked the valldity of the assessments TO INVA ASSESSMENTS, a New improvements in a number of suits Dow pending in the district and superior courts, has raised a new point which he contends is sufficient in itself to invalidate the as sessments whieh he is attacking. tuted yesterdey by him against Robert Bleakly, the city of Council Bluffs and the county auditor and treasurer. Benjamin has contended in the suits now vending that the assessments for property In which he is interested without any regard (o the benefits which it derived from the improvements and that all of the statutes of the state of lowa and all of the ordinances of the city of Council Bluffs which authorized such assessments made in any way were unconstitutional and vold and in conflict with and contrary to the constitution of the United States The point raised by Benjamin is that tNe speclal assessments against the property involved were never properly made by the city council and that therefore the certifi- cates of the city clerk that such assess- ments had becn made were without author- ity and conscqiently void. At the time these assessments were made the city clerk used printed blanks and when the notices of asscesment were published in the official newspaper of the city a clipping therefrom was posted in a scrapbook but no copy of the resolution was ever entered on the records of the city council proceedings. It is contended Ly Benjamin that the scrap- book containing the printed clippings of an official record of the city In the petition filed yesterday his conten- tion is set forth as follows: That at fome time prior sale_the city clerk of the Bluffs certified up to the county auditor certuin specinl assessments for paving, grading, curbing and sewer in front of the safd lot, certifylng among other things that the' said special assessment had been duly assessed against the sald lot by a resolution of the city councll of the said ety of efl Bluffs, T truth and fact the wald special asses it certified up to the county auditor never as- sessed against the said lot by the said city councll and that the by the city clerk was and void That the county suditor of said county. relying on the said certificate of the cliy clerk, placed the sald speclal assessment on the tax hooks of the sald county and the sald special assessments became a cloud on the title thereto. This new point will be ralsed in addition to the others in all the suits brought by bim agalnst the city aud umow pending. to the sald tax city of Council it authority amount Involved is comsiderable. The re sult of these suits is of much importance to the city. Another point ralsed by the Benjamin in the suit filed yesterday Is that mo proper notice of the expiration of the right redemption was ever served upon the per- son in actual possession and occupation of the premises. The law requires that notice shall not only be served upon the person in whose name the property is assessed, but also upon the person in actual posses- slon and occupation. In these cases no- tice was served upon tho persoms in pos- session, but were directed to them, but were made out In the names of the person against whom the assessments were made as owners.
