Important Fusiness to Comes Up at Its Annual Session, RELIEF OF SUPREME COURT NECESSARY Bills to Expedite Work of the Judges Wil Be In uced in the Hope The Nebraska State Bar association will hold its next regular meeting at Lincoln Wednesday afternoon and cvening, begin- ning at 2 o'clock. The afternoou session wil! be devoted to a discussion of proposed bills for the relief of the state courts and litisants which will be presented by the legislative committee of the association to the next legislature Tho most fmportant of these bills is one reluting to the relief of the supreme court The proposed bill has been prepared by W D. McHugh, chatrman of the committee, after consultation with many members of the bar, and its terms embrace the most acceptable compromise which could be reached. Briefly, the supreme court will be authorized to appoint nine standing referces whose duties shall be determined by the rule of the court. It is the intention ol the authors of the bill that referees shall be given power to hear all cases re- ferred to them by the supreme court and | determine the facts and conclusions of law With this system in vogue nine cases can be heard and decided where but one can come before the court at present. At the same time the system of referees obviates {the objection urged by many lawyers ogainst the commissioner system, as e case is passed upon, at least formally the supreme court itself, ¥ by ducing the time in which appeals can be taken to the supreme court from the dis- trict court. At present appeals can bo taken within six months after the close of the term at which the judgment is rendered end ap- 1s on writs of error may be taken at 1y time within & year after the close of the judgment term. It is proposed by the assoclation that the time in which the ap- peal way be perfected be made the same in each case and not more than six months allowed The question of foreclosure of mortgages will receive attention, as the assoclation desires to have a substantial bond required in cases whero appeals in foreclosures are made. At present, it is stated, the system of “waste bonds" is in force and any one can appeal and not be responsible for the value of rents while they hold possession of the property pending a hearing of the appeal. At the evening session a banquet will be spread, the guests of the association be- ing General Manderson and Charles J Greene of Omaha, Henry D. Estabrook of Chicago and John N. Baldwin of Council Bluffs. The association desires to have a full representation of the Omaba bar at the meeting and banquet regardless of membership in the association and requests all persons mot members of the organi- zation who desire to nttend to send their vames to Judge Wakeley, nresident of the assoclation, or to R. W. Breckenridge, res- ident member of the exccutive committee. P. Morgan & Co., who arranged the purchase of the Pennsylvania Coal company by the Erie rallroad, have beer arranging with their banks for a loan of $20,000,000 has been known for several days and the presumpticn was that this cosh was to be used in the liquidation of the in- debtedness of the Erie to the Penusylvan Coal company's stockholders.
