Maly, formerly city clerk and for the last year a bartender, was perhaps fatally injured In a shooting affray that occurred about 8 o'clock last night in Frank Dolezal's saloon at Twenty and Q streets, South Omaha The shooting was done by a mur Stegeman, an of Armour & and was not directed at Maly, but al Hickey, with whom Stegeman had trouble before he entered the saloon Hickey and Stegeman entered the pla together, both showing sign intox tlon, and quar After standing the bar together a couple of minutes St man walked back to the front partition door and stopping suddenly drew a ol ver from his hip pocket and fired five shots in rapid succession at Hickey. All of the abots, however, missed the intended mark and two of them struck Maly, who was standing with his face to the bar and his back to Stegeman One shot entered Maly's back just below the elghth rib and another plerced his right heel. The injurcd man was promptly removed to the South Omaha hospital, while his assailant escaped in the cltement. At the hospital Maly was attended Drs. Curtis and Schindel and it was found that the wound in the back was of a na- ture that will probably prove fatal doctors probed for the bullet, but could not locate it, and they are of the opinion that it is either lodged in the lung or, hav- ing spent its force in passing between tho ribs, dropped into the stomach. Dr. Cur- tls stated at 11 o'clock that Maly was rest- ing eastly, but the chances for his recov- ery were but one in a hundred The infured man lived with his wife and two children at 205 North Nineteenth street. The sub-committees of the three charter revision committees met yesterday after noon at the office of the mayor for the purpose of taking up and discussing some of the disputed sections of the three ch ters now in evidence. These committe were made up as follows Commer¢ club—P, A. Wells, A. M. Gallagher, J. 8. Walters. Citizens— H. Murdock, J. J. Breen, T. J. O'Neil. Council--W. C. Lam bert, W. P, Adkins, Ed Johnston, The charter drawn by the sub-committee of the council was produced and read, sec- tion by section, and quite a number of sec- tions were adopted by the joint committee without any extended comment. Where a wection was read that did not meet with the approval of the majority it was passed and will be taken up later and either adopted or discarded. In the council charter provision is made for six wards with one representative from each. A three-year term Is provided and provision is made for the present officials to hold over. Under the suggestion of the council committee all city officials will be required to give a surety bond, the pre- mium to be paid by the city. In case such bond cannot be given the title to the officy must necessarily be forfeited. Removaul from défMce of city offclals is provided for by a process of the district court Any three councllmen may file charges against the mayor, while tue mayor and any three members of the council may fle charges against any other official of the city. Or, again, any seven frecholders may filo charges against city oMicials under cer tain conditions and restrictions. No bonds of the city are to be sold ex- cept at public auction or through an ad vertisement published in one of the large: papers published in Douglas county. Bonds representing $5,000 or less will be #old at auction, while securities above this amount will be advertised for, Another good provision which has been suggested by Member Johnstoo is the tion providing that no ordin; the same day it is introdu and es- pecially none granting a franchise or the renewal of the same, for one week. One more important point in this section is where it is provided that no franchise be granted or renewed where the city does not reap a revenue therefrom. Streets or parts thereof must not be vacated until after the appointment of three disinterested freeholders, whose duty it #hall be to value the property to be va- cated. In this connection the value of the perty abutting on such street must be ken into consideration There is a section for the paving, curbing und guttering of streets upon a petition of one-half of the owners of foot frontage. Should a newspaper refuse to print the advertisement at the price offered by | the municipality, the posting of the notice on the board will answer as woll When President Adkins of the council appointed his committee of nine on charter revision he named two well-known labor leaders as members. These members have suggested that all work on the streets be done by union men and that not less then $2 a day be pald for labor, skilled labor to be pald for at union prices. There is, 80 far as known, no objection to this section. To laborers in the employ of the city time checks will be issued cach Saturday night and these will be cashed by the city treas- urer. Levies will be made as follows: General fund, fire, police, lights, hydrant rental, sinking tund, library fund, judgment, repair paved streets and parks. Warrants may, if this charter is accepted | by the legislature, be drawn for 80 per cent of the levy, instead of 85 per cent. Boards of Equalization will sit two days, insteed of three. Clarence Shaffer, 13 yeass of age, acel- dentally shot himself yesterday afternoon and died soon afterward The lad lived with his stepfather, Thomas O'Donnell, at Deerfleld. At the time of the accident the boy was driving a bunch of hogs into a pen. He had a small-caliber rifie in his hand and in some way, as yet unexplained, the gun went off, sending the bullet through the boy's lungs. Mauley McCarthy, an employe at Cudahy's offices, Is reported to be down with small- pox.
