Senator-elect Baldrige has under consid- eration a bill providing for an lncreaso in the supreme court, which he may intro: duce early in the lon. The bill provides for amendments to sections 2, 4, 6 and 6 of article vi, of the state constitution, relative to the composition, powers and duties of the supreme court. The amendments, as drawn at present, provide for increasing the number of supreme judges from three to nine, but the bill may be changed so as to make the whole number six judges. It it is finally decided to have nine judges, provision will be made for the division of the Judiclary into three de- partments—one for hearing all law cases, another for the adjudication of actions in equity, and the third to cover the criminal and such other business as will mot come properly before the other two department: 1t 1s proposed to make the term of the su- preme judges nine years and to elect one each year. This bill, or one similar to it, will in all probability be passed at the forthcoming legislative seseion, unless a bill Is passed for a constitutional conveation, which would solve the supreme court and many other state problems. J. Cornish of the Board of Park Commission ers delivered an address om the Central boulevard and the mann of acquiris park additions. In substance Mr. Cornish sald: “Central boulevard has been opened from Riverview to Hanscom park. Thus far we have had no serious litigation on this portion of the boulevard. The & ment levied to pay for the land taken ls being pald promptly by property owners and no question as to the legality of the assess- ment has as yet been ralsed ia court Copsidering the unwillingness of people to be taxed for any purpose, this is & most remarkable condition and proves the popu- larity of the central park and boulevard 1dea. Your evidence would be suffclent to nullify all the work of the park board in acquiring park lands for several years past. In fact the Board of Park Commi sloners would bte glad to have all of its work undone unless competent real estate experts bolleve that the special benefits accruing to property owners in the vicinity of park and boulevard additions exceed greatly the cost of the lands taken. While we realize that there are certaln moral educational and advertising advantages in a park and boulevard system, yet in the present condition of our city's finances we would not let such considerations weigh in the least, but prefer to base all our a tions in acquiring additional park lands on the one proposition, viz., that the cost of the improvement is far less than the in- crease in the value of adjacent lands by reason thereof."” Mr. Cornlsh then explained the former system of acquiring lands by fssuing bonds of the city to be pald for by general taxi tion, and argued that the undesirable lands then obtained ard the high prices pald were due to the inherent fault in the system. A desirable park could not be obtained with- out throwing a bait to other parts of the city by giviog them park lands that were not desirable. Log-rolling resulted. When the lands were condemncd adjacent prop- erty owners profited by having the city pay high values, thereby tending to increase the market value of their own lands. Real estato agents made enemies and no friends by testitying for the city. They therefore either refused to testify or placed exorb- itant estimates of values. Peopte Must Have Their Way. Under the present system the park board retuses to designate any lands as necessary for an addition unless property owners in the vicinity petition for the same and ex- press their willingness to be taxed to pay for it. This makes each park addition stand on its own merits, and no lands are acquired unless adjacent property owners belleve that their lands will be increased in value by reason thereof 8o as to justify the payment of taxes. The property owners to be taxed are as familiar with real estate values in the vicinity as the parties whose lands are taken and are as competent as witnesses, and therefore the court and jury, by welgh- ing the evidence, are able to do justice. Justice alone in such cases satisfies both the man whose property is being taken and the man whose property is being taxed to pay for the same. The beneficial effect of the system is shown by the values paid for re- cent park additions being only one-fourth as much as paid for similar land; years ago, without any resulting litigation what- soever. Mr, Cornish then quoted extensively from park reports of Omaha and other eities showing the effects of park improvements upon real estate values in the vicinity, and requested the members of the exchange to study reports from others cities with view of educating themselves upon the sub- ject, that their influence and evidence, it called upon, might be favorable to the gen- eral park and boulevard 14 GHOSTLY GROANS EXPLAINED from a Graphophone Located in an Unused Room in Mi ugh Restdence.
