The child was brought before the court on a Writ of habeas corpus secured by the father. His petition was that the little one be taken from the custody of the mother, who has been caring for her, and entrusted to him. After hearing many wit- nesges relating to the comforts of the child's present home Judge Baker decided to allow the mother to retain her, giving the father the privilege of visiting at the houso as often as he chooses. The case had attracted sufficient intorest to fill the court room with spectators, al- though tho hearing was bLeld in unusual hours. One reason for the wide-spread at- tentlon lles in the sensational divorce suit contested by the McBrides in the district court not long ago. The father of Margaret 1s a policeman. Mre. McBride asked for & divoree on the ground of cruelty. Her hus- hand filed an answer, denying the allega- tlon and entering a counter plea also of cruelty. Rice, an ofl dealer of the Maglc City, tho bucksters' ordinance, which has fur- nished the animus for the contention, will be tested In the district court. On the ap- plication of Rice Judge Keysor has issued an injunction restralning . C. Murphy, the clty prosecutor, and Patrick J. King, the police judge, from enforcing the provisions of the ordinance pending a hearing on De- cember § to test Its validity. Rice and the officials mentioned have heen at odds over the ordinance ever since its passage in Sep- tember, and on scveral occasions Rice has been before the courts in consequence of actions fnstitute y Murphy and King. In applying fo restraining order Rice contends that Murphy and King are in a conspiracy to destroy an oll business which it has tuken ten years of hard work to build up. He asserts that his trade is large and that Murphy knd King, conspiring with others, have sccured the passage of an ordinance llcensing hucksters and ped- dlers. Ho complains that since the ordi- nance went into «ffect Murphy has caused his arrest twice 1 the charge of violating its provisions, and that King has fined him twice, on the first occasion having fmposed a fine of $10 and in the second case one of $5. Rice makes the charge that Murphy and King are conspiring to damage him still further by the same means, and wiil do o unless the court intervenes. He maintains that he is not a peddler, but that he only delivers the ofl in the same way that a shopkeeper would. The petitions specify that on March 2 1809, Burton A.
