ENJOINS 'BUILDING INSPECTOR Farnam Street Bullding Must Be De- molish iIf at A in a Leaal Manue In the United States court Tuesday after- noon Judge Munger decided the application of W. Farnam Smith and others against the city of Omaha and the building inspector thereof, for an injunctlon restraining the inspector from demolishing the building at 1314 Farpam street The inspector served notice on the plaintiff that the building in question, being a frame structure inside of the fire limits of the city and of less than halt the value of a new building of like style, could not be repaired, but must be removed, and that if the owner did not re- move it the fnspector would do so. In granting the injunction against the in- spector the judge took occasion to especially point out the fact that he did not enjoin the city from demolishing the building Ac- cording to law, but simply enjoined the in- spector from acting without authority of law; that the chartor provides that the in spector shall report all such cases to the Board of Public Works, which shall pro- ceed to condomn the building and order its removal case the owner of an adjoining building had attempted to have the frame house con- demned by law in the state court. The de- tendant removed the case to the federal court and the plaintiff opposed the re- moval. Decision will be rendered next week in, ral Excarsions.
