Judge Cornish finds that a contrs made between the Chicago, St. Minneapolis & Omaha as party of the first part, and the Omaha & Republican Valley rallway as party of the ond part, whereby it was agreed to operate trains from Norfolk to conncct with the Sioux City Dridge company at Covington, Neb. That the party of the second part agreed to pay to the Chicago, St. Paul, Min- neapolis & Omaha as rental a sum equal to 3 per cent per annum upon $1,067,700 and one-half of all taxes which should be legally assessed and a sum equal to a proportionate share of the expenses of operating, renewing and main- tiining sald line of rallway, to be determined in proportion as the number of wheels run over said railway by the party of the second part should bear to the whole number of wheels operated, and a sum equal to the proportionate share of the expenses incurred for employes in the performance of duties ineident to the joint use of the railway, to be determined upon a wheelage basis. That the joint roads should bear thelr proportion of operating expenses, maintenance of way and betterments. Under the head of “‘maintenance and betterments” the testi- mony before the master showed that per- manent stone culverts were built, heavy fills made, fron truss bridges erected, which the Unlon Pacific had to pay, standing as it did at the back of the Omala & Republican Vall With the favorable nature of the contract running toward the Chicago, St. Paul, Minneapolis & Omaha they took ad- vantage of the contractual relation and pro- ceeded to squeeze the road for all it was worth, and having extracted all the blood possibla they failed to show any reason for continuing the operation of the contract, and it is abrogated, having been running since May, 1889 THOMAS OAK t was Paul, ULLY EXONERATED. Judge Jenkins € ends His Conduct and Condemns Villard, MILWAUKEE, Oct. 15.—Judge Jenkins de cision, which was filed in the United States cireuit court today, confirms that portion of Special Master Carey’s report which exoner- ates ex-Receiver Oakes. The judge com- mends, at some length, the conduct of Mr. both as an official of the Northern Pacific road and receiver of the company. The decision reviews the master’s report in detail. After referring to the history of the petition for the removal of the receivers, stating that it was dismissed by the court as to Messrs. Payne and Rouse, and was referred to Master-in-Chancery Carey for an examination as to Mr. Oakes, the decision states that there were four questions to be determined by the master; First, whether any of the Northern Pacific directors had made unlawful gains out of the Rocky Fork and Cooke City deal. Second, whether any of the directors had made unlawful gains out of the Manitoba deal. i Third, gains in deal. Fourth, whether an exorbitant rental had been paid for the property, whether anybody in the Northern fic made anything out of the leasing of the terminal line: Lastly, whether in respect to any of the transactions directed to be investigated Thomas F. Oakes knew or ought to have known of them, and what measures, if any, he took to, in preventing thereof the pro- tection of the interests of the Northern Pa- eific iroad. The rate applies from Kansas City, but from no other of the common gateways.
