CHICAGO, ft. 8.—Judge Jenkins of the United States coutt presided today In the ontinued hearing of the application of the orthern Pacific recelvers for leave to issue of recelvers' certificates. Henry one of the receivers, was present, with ex-Senator Spooner of Wisconsin. M. H. Cordozo of New York represented the second mortgage bondholders, opposed to the fssue, claiming that it was unjust to the second and thrd mortgage bondholders. At- torneys for the receivers followed with argu- ments for the application Mr. Newell, for the receivers, said the receivers had labilities aggregating $6,000,- 000 to meet within the next few months and the assets avallable do mot exceed $400,000. At least §1,640,000 s due now mnd must be paid. The honor of the court, which is in control of the road, must be malntained by mecting the liabilities as they fall due. The attorney sald that while the attorneys had petitioned for $5,000,000 they could possibly get along with less, but they must have at least $1,800,000 to meet pressing debts and carry on the business of the road. He sald the receivers would be willing to have the or- der for the certificates drawn in such a way as_to meet the objections of the bondholders. Mr. Petit followed with an argument in opposition to the certificates. In referring to the securities to be put up by the re- ceivers, he said the Northern Pacific securl- ties were lke Northern Pacific memories, considerably below par. It is belleved that the result of the argument will be an agree- ment between the different parties as to the manner of the bond issue. The argument was concluded In the after- noon and the court decided in favor of the recelvers. Judge Jenkins granted the ap- plication for leave to issue certiicates to the amount of $5,000,000 and ordered the re- colvers to report to the court on October 22 the bonds which shall have been received for them and the rate of interest oered. The court took up the report of the master in chancery on the application for the re- moval of Thomas F. Ouakes as recsiver. The report, which was submitted to the court at Milwaukee some weeks ago, exonerates Oakes from the charges of illegal practices in the manipulation of the Northern Pacific prop- erty, and the company and bondholders filed a motlon rejecting it. Judge Jenkins sald he would ‘devote the evenings of this week to the argument on the motion. Payne, EMIGRANT BUSINKSS Western Lines Threaten to Keopon Offices I the East. CHICAGO, Oct. 8.—At today's meeting of the advisory committes of the Emigrant Clearing house of the Western Passenger assoclation a formal protest was sent o the Trunk Line association, declaring that the distribution of the emigrant business was made a matter of agreement between the two associations, and that the action of the trunk lines in canceling the agreement without conference and apparently without cause has caused much surprise to the west- ern lines. It Is asked that all action in the matter be suspended immediately and until a conference can be held between the two assoclations in New York. The western lines say that if such a conference is to be held they would prefer that it should be either on October 15 or 17. The protest winds up with the declaration that it is the belief of the western lines that the trunk lines are not willing to push matters so far that the western lines will be forced to take inde- pendent action, which simply means that it the trunk lines porsist in their present course the western lines will find it necessary to establish ticket offices of their own through- out the east to look after their interests, The trunk lines have made a demand on the Western Passenger association lines that they at once withdraw all their orders from trunk line territory. They declare that the invasion of the eastern territory by the west- ern lines is without reason or excuse, and is resulting in much loss of revenue to trunk lines. There is much doubt as to whether the assoclation will pay any attention to the demand, for the reason that the matter is one that is hardly in the jurisdiction of the association agreement, and all the lines are free to act as they see fit in this matter. They first put all thelr orders in the terri- tory of the eastern lines because they thought they were not heing treated with entire just'ce in the matter of routing through business. and 5o took this remedy Into their own bands. The association, as an ussocl tion, will very probably take no action of any kind in the matter. All in all, there seems to be an excellent chance for some Warm times between the Western Passenger assoclation and the Trunk Line association before things are adjusted. Tiokot PREPARING FOR THE FIGHT, Union Paclfic Will Opposo the Demund of the Great Northern, The club with which the Oregon Rallway and Navigation company proposes to beat out the brains of the Union Pacific has been furnished Receiver McNelll by the Great Northern, President Hill having acceded to the demands of a blanket proportion of 29 per cont on all eastern business having western tendencies. But the Unlon Pacific does not propose to be taken into camp with- out a struggle, General Passenger Agont Lomax being enroute to Portland to inter- view Receiver McNelll on his proposition, Mr. Lomax in this fight has a united board of recelvers back of him, as well as the gen- eral manager, and the fight promises to be one of great importance in the history of transcontinental lines With the opening of the Portland office by General Agent Baxter it fs understood M. Thomas Schumacher of the general freight office will go to Portland to coach Mr. Baxter in freight rates, Mr. Schumacher's title to be that of general westcrn freight agent, with headquarters (n Portland, Mr. Schumacher has Leen in charge of transcontinental rates since Mr. Woodworth severed his connection with the Union Pacific. He ls in every way an aggressive freight man and will make the Oregon Railway and Navigation people “‘hus- tle” for business. Bonds Have Disappeared. NEW YORK, Oct. 8.—An evening paper says the committeo on reorganization of the Chicago & Northern Pacific railway has dis- covered that $2,600,000 of the company’s bonds of the value of $1,000,000 have disap- peared from the treasury of the company, The committes has discovered also that somo of the securities of the company have been put up as extra margin in loans made by the Northern Pacific company.
