Bedas County—Small grain will not aver- age over one-fourth of a crop; corn and potatoes are doing nicely. Colfax County—Showers have fallen nearly every day and sunshine immediately follow- ing them is jumping corn to the front; oats will give a small yield. DES MOINES, June 26.—The fowa crop bulletin says: The drouth s practically broken in all parts of the state, though in the central district more rain is needed to revive pastures and replenish the water sup- ply. Corn was never cleaner or more prom- ising in the last week of June. The stand is remarkably even, and in the larger part of the state it is about ready to “lay by." Oats have headed with short straw, and the heads are generally deficient in number of grains. The quality of the yield fs likely to be greater than In recent years. Yesterday Judge Scott was pretty sharply turned down by the supreme court. In 1891 Edward Hargeshelmer was convicted of for- gery In the Douglas county district court and sentenced by Judge Estelle to four years in the penitentiary. An appeal was taken to the supreme court, on the refusal of Judge Estelle to grant a new trial, and Harges- heimer was released on bonds, pending a review of his case by the higher tribunal. In April last the supreme court afirmed the decision of the district court and the sherlff was instructed to see that the sen- tence was put in effect. Sherlff Drexel had placed Hargesheimer in jail, preparatory to taking him to Lincoln, when an attorney em- ployed n the prisoner’s behalf placed before Judge Scott a bunch of aflidavits purporting to show that the prisoner was insane. Judge Scott, disregarding the mandate of the su- preme court and ignoring the exclusive juris- dlction of the insanity commission in such cases, adjudged Hargesheimer insane, granted a new trial and released him on bonds to appear on the first day of the Sep- tember term of court. County Attorney Kaley objected to such procedure, but his objections were promptly overruled by Scott. Yesterday the attention of the supreme court was called to the matter by Assistant Attorney General Summers, whereupon & peremptory writ of mandamus was issued ordering Sheriff Drexel to at once carry out the judgment of the lower court in tho first instance and take Hargeshelmer to the peni- tentiary. . He has also announced that on June 29 and 30 and on July 2 and 3 he will hear motions, de- murrers and exparte matters, Cunningham R. Scott of the criminal beneh was not in a happy frame of mind yester- day, for at an carly hour he learned of the actlon of the supreme court in the Harges- heimer case. From that time on until the noon recess he devoted a goodly portion ot the time to roasting the members of the si- preme bench, especlally Chief Justice Norval, because that gentleman overruled one of the decisions made fn the Ackerman case. Adam Snyder, the ex-treasurer, who I8 charged with having embezzled county money, was in the criminal section yes- terday, where he renewed his bonds in the sum of $4,600, James Stephenson signing as surety, after which the case was con- tinued until the next term. In the same case the men who were on the official bond of Mr. Snyder have filed a motion asking that the complaint and information be made more specific. The case of John Scarda, a minor, by his next friend and against Willlam Hughes, Themas Rock and Joseph Kalson, has been dismissed as to all except Hughes.. This 18 the case against one of the policemen of South Omaha. The petition recites a long story, which Is to the effect that one day Hughes; the policeman, was chasing a bad man, who took a turn over a vacant Lot where a number of boys were playing.
