Plans were freely cussed for meeting any contingency that might arise. It developed during the dis- n that the roads have by no means exhausted their resources by the announce- ment of a $i5 rate. Even should the South ern Pacific_prevail on the trunk lines not to use the $16 rate as a basing rate, the west roads will keep t in’ effect in a way that the Union Pacific: will have cct it, accept their terms, or go out of busines: There is no likelihood of the trunk lines paying any heed to the Southern Pacific's del s, however. They hav given assurances that they will maintain the rate. Even if they were desirlous of witl drawing they could hardly do so at thi juncture, because they have notified all their agents In Burope of the existence of the rate, and a good deal of business has already been booked. It has developed that in objecting to the rate the Southern Pacific is not trying to help the Union Pacific so much as it is anxious to preserve its own revenue. T said they had given no serious consideration to the matter, as they had no desire to hurt their neighbors where no direct good would result to themselves They did not deny, however, that the matter had suggested itself to them, and admitted that it might ultimately become necessary for them to take the step indicated. If it became apparent that conncctions of the Unfon Pacific were sccretly parties to the piratical methods being pursued by that road to secure business, it might be necessary to administer a rebuke where it would be most felt by cutting domestic rates east of the river. In the meantime the Santa, Fe is simply following the other roads lead and making such rates as to meet those an- nounced by them. Rock Tsland’s Kent Sult Declded. CHICAGO, April 24.—(Special Telegram to The Bee)—The Chicago, Rock Island & Pa- cific and the Unlon Pacific railroad com- panies appeared as litigants before Judge fcConnell today in the circult court. The Rock Island is suing Recelver Clarke of the Union Pacific for the recovery of $150,000 rental, sald to be due on a contract made by President Adams in 1889, whereby the Rock Ysland was to build from Omaha to Lincoln, Neb, and the Union Pacific was to pay rental for the use of the tracks. Jay Gould later secured an injunction restraining the tock Island from the use of the Omaha bridge. This tied up the branch road, and President Dillon of the Union Pacific a ated the contract. Subsequently the Rock sland secured a dissolution of the injunc tion. The line, however, was never used afterward and the Rock Island the Union Pacific for what it claims 15 due on the contract. James M. Ryan was menced in the probate co where the relatives of the deceased are seeking to show that at the time of the execution of the will Ryan was in a condition of mind which made him absolutely incompetent of disposing of his property. Rev. James M. Ryan was a priest in the Catholic church and was for a uumber of years a resident of this city. He died one month ago, and soon after ls death it wes discovered that he had left a will, bearing date December 25, 1891, in which he be- queathed $5,000 to Mary Lamb, and the bal- ance to the Right Rev, Riclard Scannell, bishop of the Catholic church. In the will Rev. T M. Conway and Thomas S. Coffec are named as the executors, The parties who are contesting the allege that the disposition of the property was contrary to law and against the best interests of public policy.
