The testified that he made the deal, which called for tho payment of $600. Bennett was no more interested in the deal than were other candidates. The witness had or Ipss In distributing the papers. ouls Littlefield was next calle. it He heard City Editor Hunter of Tho Ree say that the paper was opposing Bennett because {t was not getting a scoop. He testified that he did. On cross-examination, he sald he told Hunter that the attack on Bennett was uncalled for, and Hunter re- plied, orge Is all right, but The Bee isn't getting a scoop.” The witness sup- posed a scoop meant advertising. He was interested for Bennett. When asked whether he supported the entire republican ticket, the witness ovasively replied that he supported the entire county ticket. George A. Bennett was next called. He testified as to the deputies and jailers that he employed and the length of time they worked for him. He occupied sleeping rooms at the front of the residence portion of the jall. They were at least twenty feot from the Jail office and there was a brick wall between., It was necessary to go down stairs in order to get to the jail office, The key box in the jailer's office was kept locked. The witness never saw jailers or prisoners drinking liquor in the “fail. Would not allow liquor there if he knew it. No in- structions were given the witness at the time Mosher was placed In the jail. Had a conversation over the telephone with the United States marshal. The witness told him ho had investigated the newspaper re- ports and found them untrue. Theodore Bennett generally took Mosher to his meals. The witness took Mosher out to Mo; in answer to a telephone call. Mosher went to hold the team That was the only time Mosher was ever out with the witness. Mosher never had a jail key in his hand. He was allowed to go out on the lawn quite often and sit there with either the witness or some of the jailers. The witness under- stood Mosher went to the hospital one night with the jailer after a crazy man. The Jailer slept in the jail office. Horn slept with him after April, 1893. Witness never observed anything improper or immoral in the conduct of the jailers. Never knew of any instances of unbecoming conduct be- tween men and women in the jall. Edna Marshall told the witness while going to the penitentiary that she had been criminally intimate in the jail with Deputy Jailer Ernest. As to the testimony of Mark H. May re- lating to the stop on' Ninth streef, the wit- ness said he was there about five rainutes, and May bought a bottle of beer and drank it with the girls. The witness did not drink. May seemed to have no business there other than to “josh’” the girls. A prisoner named Dutcher escaped from the jail and has never been recaptured. The witness did not know anything about the escape. Ferguson, Fitzgerald, Rice, Douglas and another one also escaped. They went out through a coal hole while' the Jailer was up stairs. Several others got away, but the witness got them back. These escapes all occurred while Theodore Bennett was jaller. The jail was scrubbed every day and kept clean. The witness never knew of Lilas Page being sick In the county jail. Never heard of an abortion there until he saw it in The Bee. On cross-examination, the wit- ness said he had an introduction’ to Rose- water five years ago, put no further ac- quaintance until nominated in 1891. Rose- water did not oppose his election that year. He visited Rosewater that year, but dfd not feel very friendly toward him. Rosewater asked for no promises or pledges, and said he rather liked the appearance of the wit- ness, and would support him, The witness was examined at length as to the arrangement of the jail. He said the opening of the door leading to the woman's department would always awaken him. He was so aroused at least half a dozen times, and Mrs. Bennett inyariably went down to soe what was going on. It she sald on the witness stand that this-had only occurred once he didn’t know whether she was mis- taken or not. The witness and his wife were away together on several occasions. Thiey were away about ten days in 1892 on a trip to Fort Worth, Tex. During these trips the jailers were in charge of the female department: She was not gone over fifteen days in the two years, The witness heard of beer being In the jail last fall on one occasion and he Investigatea it. That was the only time. The deputies denied that Mosher had been taken to saloons, Mosher also denied it. He also denied that he had been taken to assignation houses. The wit- ness made an Investigation of the newspaper charges and told the United States marshal there was no foundation for them. He vis- ited the World-Herald office in company with A, R. Sauer, but denied having then said what he was quoted by that paper as having said on the occasion of that visit. Sauer stated then that Mosher had admitted to him that he had been out to assignation houses, and Sauer had previously, told wit- nesp the same thing, but Mosher had denled it. SS:n\u-r was at the jall frequently to see her. When they came out of the World- d office Sauer said it was a lie, but wlit- ness did not take any pains to undeceive the World-Herald people regarding the state- ment. PRIVILEGES TO PRISONERS, Mosher might have repeatedly had a key of the jail in his hand, but the witness-had no knowledge of fit. Mosher frequently stayed out on the lawn till 9 or 10 o'clc at night. The same was true of the wit- nesses who were held in the Goldsmith case, Henderson and McCarty had the same priv- ileges, but the witness could not recall any other prisoners charged with crime, who had been accorded these privileges. Dodrill and McGlnn were out there once for half an hour. This was when it was reported that a mob was forming to lynch McGinn. They were not out for the purpose of enjoying themselves, as was the case with the others named. Henderson and Mosher were out very often. They were accorded more privileges than the average prisoner. This was because they were clerks in the office, The witness pald $40 for the recapture of the four women who escaped on the Fourth of July, and had put in a bill to the county, Tho state had paid the bill for the expense of bringing back Blanchard after his escape from ‘the sherif's ofiice. The witness felt no qualms of conscience In asking the county to pay these bills, as he did not con- sider that his personal negligence was the cause of the escape, and he did not feel like standing the expense himself. The witness visited the World-Herald to- stralghten out a misstatement, but he did not go to The Bee. That paper had roasted him about everything. He never mentloned the matter to Mr. Rosewater. The Bee people never directly asked him for patronage. It was ims possible for any one outside the jail to have visited Edna Marshall and to have had intercourse with her without the connivance of the jailer.
