President Graves, who arrived at the bank shortly after. said “I'his1s a high handed proceedi 1 don't understand it. 1 supposed this bank was eolvent.” “Phe St. Nicliolas bank acted as the clear- ing house agent for the suspended Madison Square bank and the examination being maae by Superintendent Preston is due to the connection of the St. Nicholas with the Madison Square bank. Upon the failure of the Madison Square bank the St ne bank withdrow from that institution some 950,000 worth of securities in order to secu ftself, but it is understood that thqgsSt Nicholas bank affairs have been unsettled ever since that time. The bank consequently held a reserve of 25.4 per cent. The deposits last night had been reduced to about §2,000,000. Pe; ant with the bank’s condition sav that there has been absolutely nothing like dishonesty in the management, though bad judgment has been shown in the conduct of business. Svperintendent of Banks Preston held a conference with Messrs, Tappin of the Gal- Jatin bank and Nash of the Corn Exchange bank, a8 mewbers of the clearing house com- mittee. Mr. Preston examined the books with these gentlemen and found that the capital w. ¢ impaired. Mr. Preston accordingly decided to close the doors of the bank pending furtber investigation. It believed that the assets are suflicient to pa) the depositors in full. Commission Men Objeet to Being Held Up by Dishones: Employes. The live stock commission firm of Speits, Hitehicock & Oluey, the South Omaha Live Stock exchange and the Union Stock Yards have all engaged ina legal fight, all of which has been brought about by the alleged dishonesty of some em- ployes. The members of the commission firm are plaintifis and the action is brought to re- straio the defendants from expelling them from the beuefits accruing by reason of being members of the exchange. In the petition which s on file the plain- tiffs allege that for o long time they have been members of the exchange, doaling in cattie, hogs and sheep, and that” during all that time it has been the custom of the ex- change to purchase from the stockynrds company the feed for the stock co:signed to the members who were in good standing. Some months ago the plaintiffs allege that they discovercd that their employes and the employes of the stockyards company had conspired to do them up on_the question of feed. This, they s handled by their own employes buying «from the stockyards employes a'small amount of feed, which wus charged at more than double the amount. When the members of the firm learned this they registered a_complaint, which was in- vestigated. The investization resulted in a finding of the fact which they had claimed The same investigation proved what the em- ployes had been worlking the stock yards company and_that they had neld that pany up for This amount the plain- uffs were asked to pay. They refused to contribute, after which the stock yards people signified their intention of expelli the plaintiffs from membership. The in- junction which has been issued prevents this action until the case can be investigated by the courts. Mrs. Tussler's Case. The family fight between Catherine Tns- Dr. Keenan, ‘Henry P. Stoadard and am E. Healey has been given another in the courts by the filing of a suswer of Heale; He admits that he wi a student at tte university Madison, Wis.; that he married Mrs. Lus: duughter, and that there was a groat fight over the possession of the horse ranch out in the western part of this state, but he abso- lutely denies that he and Stoddard con- spired to defraud the woman out of her property. Web- ster, Immediately after the filing of the vetition Judge Ambrose issued an injunction ro- straining the defendant from entering the Pierson premises and interfering with the business conducted therein. The cuse was set for hearing on January 4. ‘The defendant in this action claims that about December 15 he visited the place and while there attempted to caress the tiger. This caressing act, he avers. he performed and lost the sum of #1.100, which he bet on some game of chance, played with cards, At o subscquent date, it is alleged that the defendant tried to extort money from the plaintiff, but falling in this he had him arresied and taken before a justice of the peace.
