ACTION OF THE COUNCIL CONDEMNED Veto of tho Muyor Dodged by the Gas Ring—WMembers of the Counenl Express Themseives on the Action of the Body. Public sentiment in Omaha is aroused to its highest pitch over tho action of the gas ring in the civy council Tuesday night. It has beon years since such condemnation has been heaped upon the heads of the me bers, Since the days of the old city hall steal and the smuggling through of the &0,- 000 claim of the gas company, there has noy been an action more universally condemned than that of the council in the entire pro- ceedings granting the franchise to the gas company. Notwithstanding the fact that the merits of the ordinance have been universally dis- cussed, its inconsistencies and shorteomings hela up to public view and the district court has restrainea the body from passing the same over the veto of the mayor, Hascall, Wheeler and the leaders of the movement, adjourned the couuncil, without a moment's warning. The adjournment was taken for the sole purpose of claiming the ordinance a law, because of the absence from the clerk's dask of Mayor Bemis' veto. It is true that the veto of Mayor Bemis was not on the desk of the clerk when tho council adjourned, It is also true that hang- ing over the head of Mayor Bemis was an injunetion preventing him from approving the ordinance. He was not compelled to re- turn the measure to the council until court had passed upon the franchise, papers from the miyor ave nover filed with the clerk until the council has commenced business, Formerly it was an old dodgo o got possession of the mayor's papers and in case there was a veto and the corporation clans were not sure of cnough votes to carry the measure over the veto, to adjourn for few days una hateh a scheme to’ secure the necessary votes, Mayor Bomis dropped to this game and he did not propose to have the taxpayers imposed upon in such a man- ner. As a result he concluded that his papers should be filed while the council was approving the journal of the previous meet- ing. ‘This has been the custom for severnl months. Tue: v night was no exception and Private Secretary Millar held the papers as usual. lnstead, however, of going iato the order of business the council simply ad- journed. The vapers were immediately placed in the hands of City Clerk Groves and he accepted them. They are in his oftice today. All sorts of tricks have been resorted to, and it is necessary to point out but one to show to what ends the Hascall foliowers would go. Some one tampered with the clock 1n the council chamber and it was turned ten minutes ahead. After the meet- ing adjourned the time as shown by the clock was compared with a_large number of time pieces in the room. The attention of Superintendent Mathieson was directed to the discrepancy and he turned the hands back ten minutes. By the turning back of the hands the council met seven minutes prior to the time it is alleged it should, which is S o'clock. It h been the custom of the body to meet at that hour, but there is no law or rule demanding it. Not a word us to the hour or day of meeting is incorporated in either the charter, ordinances or rules of the council. If there is a time fixed it was made by a former council by motion and the present body is without a regular hour of meeting beyond what practice has mude. The members of the council are ontspoken upon the position they have assumed. Mr. Munro's Plain Talk. Mr. Munro declares that the hasty adjourn- ment of the city council Tuesday night was 2 snap judgment on the part of the friends of the gas company and supporters of the gas franchi He contends that the ad- Jjournment w ccomplished before 8 o'clock and in accordance with a plan agreed upon before the council was called to order. The motion to adjourn was made by Hascall and was put through without a second, before anyone had time to get the floor and make an objection. Mr. Munro believes there has been such a change of sentiment among the members of the council respecting the gas ordinance that if an op- portunity had been given Tuesday night to vote on the veto of the mayor it wouid have been sustained. He aftirs that Hascall is playing the same tac tics that he used when the Holly water- works matter was up several years ago, and he is inclined to think that if the friends of the gas ordinance persist in their present wild course the citizens will decide to take a hand, and will come up some fine evening and throw the city legislature out of the council chamber, He is sure th the citi- zens of the city are not willing that valuable franchises shall be given away in this man- ner. He does not think that the ordinance is now a law, because in his opinion the in- Junction issued operates to suspend the ruie of the ¢ charter respecting the time allowed the mayor for communicating to the city council his abproval or disapproval of a He declares he will continue his nst the ordinance to the end, and he 1s confident that with the aid of the law aud public opinion the measure will be de- feated. Mr. Saunders on tho Defensive. Mr. Saunders confesses that he is still not ashamed of his support of the gas ordi- nance or of the metnhods that have been used by its friends to push it along, which methods, he asserts, have been wholly hon- orable from the beginning. He denies that any attempt was made 1o prevent the con- tents of the ordinance from becomng known prior to its passage, or that undue haste was made 1n getting it through the council. The ordinance was introduced October 4 and referred to the judicrary committes, of which Mr, Saunders is chairman, He says it was impossible for him to got the committe together to formulate a report on the ordi- nance and publish it until the day preceding that on the evening of which the ordinanco was passed, but hie says he thinks the public had as much knowledge of the ordinance as it usually does of most ordinances before action upon them by the council. He su. that most of the statements made criticizing the ordinance ave false, us he is prepared to prove. [t was not uecessary, | 5, that the ordinance should contain u provision that the city might purchase the was plant when it chose, by appraisement, because the city is protected in this respect by a clause in the city charter. He says he is thoroughly convinced that the ordinance is not an unfair one for the city, and he pro- poses to stand by it. He calls attention to the fact that several eastern cities bave re- cently granted perpewual franchises to gas compaunies, and thinks that there is nothing wrong with the time feature of the present franchise. He says that he would vote to override the voto of the mayor, and he de clares that he is 1n doubt where the injunc tion leaves the ordinance. Major Wheeter's Clatms, Mr. Wheelet denies the statement made ty Munro that an adjournment was taken bofore 8 o'clock. He insists_that the motion 10 adjourn was made only when it was found out aftor the council had been called to order that the clerk had in his hands no com- munjcation from the mayor, and he adheres firmly to the position that under the circum stances the ordinance is a law the same as it the mayor had signed it. e says there no question about it, and the injunction is a matter, in his opinion, of mno welght whatever, Ho saysitis well settled that courts have no authority or right to direct n any manner the acts of legislative bodies Mr. Wheeler also denics that there was any preconcerted plan to bring about an adjourn ment. It would have given cheap power and the price of gas would have had to come down in order to com- pete with the electrin light. So far as the adjournment of the council w con; cerned 1 do not know what the purpose was, although 1 anderstand from the papers that it was to make the ordinance operative be cause the mayor did not haye n veto on the cioric’s desk when the meeting was called to order. This is a technical point, and my be- lief is that it would not stand for the reason that the couneil did not go into the order of business, and that the mayor was enjoined from approving the ordinance and the coun- cil from passing the same over the veto. By adjourning the courts can pass upon the franchise and the council can act accord wgly. Mr. Thomas' Posttion.
