From all accounts it is learned that Hillman left the citv on Sunday last with all the money he could scrape together. When the club house was opencd Monday morning Hillman did not appear, but nothing was thourht of the matter, as the clerk fre- quently spent Mondays in collecting and paying bills, What caused the first suspicion was the appearance of a deputy sheriff from St. Paul with papers for the arrest of Hillman on the charge of forgery and embezzlement. When this fact was reported to the directors they set to work overhauling the books, but as the accounts were in such bad shape it was hard to tell at thetime just how much money tho club was out. Only the day before, the directors had met and had passed a number of bills and had placed the money in the hands of the clerk. One of the employes of the house is out $125. All the dues collectea during the past two months went with the absconding clerk. Altogetier the total sum will probably reach 2400 or £00, Hillman was first employed by the club some ten months ago. When the board of dircctors changed he was made house clerk, and to all appearances he was keeping thé records in good shape, I dent Tuttle of the athletic club was asked about Hillman's connection with the club and said: “We heard several stories about the man and began to look them up, We had & maa who kept watching him and 1 do not believe he gov away with any of the funds of the club. W. Mosher, R. C. Outealt, R. O, Phillips, . B. Yatos, D, B, Thompson, H. J. Walsh, E. . Hamer and A, . 8. Stuart, directors of the broken bank. The petitioners were A. M. Davisand Julia Caldwell, who have deposits of &,048.06and £2,000 respectively in the broken fnstitution.. They allogo that the dofendants as diroctors had entire control and management of the bank, and that it was their duty for the information of the public, and especially for the information of the customers of the bauk to make and publish a truo and correct statement of the resources and liabilities of the bank from time to timo as the same might bo called for. That they did so issue statements, but that those made March7, May 17, July 12, Septomber 80 and- Docem* ber'd, 1802, wero false and untrue, and by oach of tho dofendants known to bo 8o, in that the resources of the bank were in each case grossly exaggerated. The March state- ment was signed: by C. W. Mosher, A. P, S, Stuart and C. E. Yates as’directors; that of April by the samo parties; that of July by Mosher, Yates and R, O Phillips; that of September by Hamer, Stuart and_ Phillips, and that of December by Moshor, Yutes and Phillips, The plaintiffs say the labilities of the bank at the sovoral dates named were very much lurger than shown by the stutements and that the items of resources and habili- ties were false and untrue, and while said statements showed the bank to bo solvent and fn wood condition, it was in fact insol- vent and if true, full and corroct statoments had beon mado at such times they would have shown the bank to have been insolvent at each and all of those times. Directors Knew of It, ‘The plaintiffs furthoer allege that each and all of the defondants either had full knowl. edge of the facts set forth or willfully and negligently failed to examine the books, papors and business of the bank as from time to time they were bound to do as direc- tors thercof, and defendants held the bank out to the community as solvent and in good condition, The plaintiffs further defendants veglected and failed to per- form the duties of their trust as direc- tors of said bank and failed to examine the kind, amount and character of the loau made by the bank, as they were in duty bound to do, and that they entirely failed and neglected to give the attention and caro to the management of the affairs of the bank that they were in duty bound to give thereto. say that the Noglected Thelr Trust.
