Several months ago the plain- tiff was at ono of the small stations in western Towa, where she was waiting for,an Owaha bound train. While she was in the depot, she alleges the station agent commit- ted a criminal assault. On account of this she sued the company for $10,000, claim- ing that she was entitled 10 the protection of the Rock Island. Tho evidence showed that when she claims the alleged assault was committed she had not purchased her ticket and that she had not tendered the necessary amount of money for the payment of the same.
