THEORY OF THE CASE OTHERWISE APPLIED Austrian Government Expels & Former Subjoct Who Preferred the United States as & Placo of Perma- nent Residence, Wasnizarow, D. €., June 4.—The decision of the supreme court upon the Chinese ex- clusion act recently delivered, may possibly have a much wider scopo and effect a groater varioty of persons than was probably fore- scon by the associate justices who joined with Mr. Gr in declaring it to be the law of the land. The volume of “foreign re tions" for 1802, just published by tho State department contains a case in point, wherein tho arguments used by a foreign government to justify or explain its docree of ex- pulsion of a citizen of tho United States, it is pointed out by those familiar with the sub- ject, aro in suggestive parallel with those outlined by Justice Gray in announcing tho opinion of the supreme court of the United States on the 15th of last month. The case, as shown by the published correspoudence, were these: ) Leon Spitzer, born in Vienna, Austria, emigrated to the United States in naturalized in New York in 1830 and ed to Burope later the same year and nno, July 1800, In un afidavit Mr. Spitzer declared that his residence was in New York, where he was a “manufacturer,” and he intended to “return to the United States within two years, for the purpose of residing and performing the citizenship theren,” In 1801 Spitzer was notified by the author- ities of Vienna that he had been expelied from Austria undera law of 1871, Ho ap- pealed to Minister Grant, who brought the case to the attention of Count Kalnoky, prime minister and minister of foraign af- fairs, protesting that the treatment of Spit- zor was in violation of tho spirit of the treaty of 1800-01 and was in violation of the treaty of 1887 between Awstrin and tho United States, guaranteeing the rights and the protection thereof to the citizens of the respective countries, Expelled for the General Good. Replying to Mr. Grant's complaint in be- half of Spitzer, Count Welsercheimb, for the minister of foreign affairs, said that Spit emigration to the United States was m: stly for the purpose of evading the military duty which the Aus- trian government exacts of citizens; that the expulsion of such individuals is based upon consideration of public order, and that “overy state has a right to expel foreigners from the territory for reasons as above stated and that the question whother and where reasons for such expulsion exists can ;)u judgea only by an international point of aw." This sentiment accords with the views ex- pressed by Justice Gray and the language is quite similar. Minister Grant notified Count Kulnoky that this government could not accept that interpretation of the treaty, a position in which he was supported = by ceretary Foster, who, in a dispatch cated June 1502, said, after stating that thoe United States would entertain a pronos tion for modification of the treaty in question, “but so long as the treaty remains in forco the United States government will insist upon a strict com- pliance with its terms and after a careful examination of the case in point, 1t is re- luctantly obliged to dissent from the views expressed by the Austria-Hungarian govern- ment. As Spitzer was expelled on the vague and indefinite grounds of the ‘interests of public oraer,’ and as no valid and expticit reasons in support of the order are alleged, vour action in making a formal protest is approved by the department.” This ended the correspondence. As Spitzer's departure for the United States was intimated m one of Minister Grant's letters, this probably closed the in- cident. In view, however, of the apparent inconsistency between the view of the execu- tiveand jud 1 branches of the govern- ment, as disclosed by this correspondence and the decision on the Geary law, the atti- tude of the government upon the case of al- Inged violation of treaty rights by the gov- ernment will be watched with interest. One of Nebraska's Wealthlest and Prosperous Seoti Fremoxt, Neb., June 4.--[Special spondence,]-—The history of Dodge county is a part of the early history of the state, and well has she maintained her position at the front. While Dodge county is strictly an agricultural country, nearly every foot of which can be and is cultivated, there is prob- ably more stock fed here than in any other county in the state, partly owing to the fact that crops ave a certainty, that its railroad facilities are such that gramn can be shipped in from the surrounding coun t to advantage, while the ppimz out facilities are not surpassed by any locality in the state. Ev vear large herds of caftlo and sheep are driven or shipped in and prepared here for the markets. The farming community is wealthy, industrious class of people, know how to farm for profit and at the s time keep the lands up in good shape. Her farmers are but hutle in debt and large numbers of them carry handsome balances in the banks of Fremont and other towns, Fremont, one of the most prosperous and pretry cities of the state, boasts of 11,000 people, and is rapidly pushing herself in the lead as the factory city. Sho has now twenty-two factories, which carry i pay roll of more thun 600 employes, besides her rail- road people. The Fremont Brewing com- pany has $150,000 invested in its plant, and is the largest and best in the state outside of Omaha, The Nebraska Creamery association 1s the largest plant in the state, as well us the fivst, it having been in continual operation for cloven years.
