HE MAY ESCAPE BY A TECHNICALITY Pecallar Wording of the Section of Statutes Boarlig on the Caso—P ks tlon Bo'leved to I3a Well Taken. Lixcory, Neb, Juno 2.—[Special to Tis Brr.]—The dofenso in the Botts caso today sprang a groat big surpriso on the prosecus tion, when &t the close of the stato's case the attorneys for Betts moved for nonsuit, The grounds on which thoy based their motion wore numerous, but the principal ones wore that when the state board allowed Betts' claim they passod on its valiaity and until their judgment was set aside, no criminal chargo could be maintained, and that prior to the act of 1501 it was no crime o obtain by fraud the signature of any ono tothe voucher and that while the offonse was committed in Aptil, 1801, the act did noy RO into effect until August of that year. Another point was tha the indictment alleges that Betts obtained tho warrant from Benton, while the proof was that ho had obtalned it from the stoward of the asylum. But this was not well taken. "The section covering this orime, No. 125, chapter xv, of the Compiled Statutes, states that “if any person, by false protense or false pretenses. shall obtain from any other person any money, goods, merchandise or of- fects whatsoever, with intent to cheat and defraud such person of the same, or shall leaso or transfer any void or protended. patent vight as certiticate, in a protendod corporation, and take the promissory notcor valuablo thing of such purchaser, or shall fraudulently make and trausfor any bond, bill, deed, gift. grant or other conveyance to defraud his creditors of their just demunds, the samo shall be, if the value is over §b, punished with from one to five years impris- onmient, or if loss than thatamount by thirty s in Juland 8100 fine." his was the statute prior to the aet of 1801, which added these words after the word demands, “orif he shallobtain the signa- ture or cndorsement of any person to any promissory note, bunk check, draft, bill of ange or any other instrument in writing: idulently or by misrepresentation, ™ The attorneys for the that the word “effects” in the old statute covered the charges made in this indictmoent, and the court aftor examining authorities decided that the position of the state was well taken., The most serious objection, in the court's mind, was that raised as to whether the action of the © Board of Public Lands and Buildings clmmed by the defense to be sitting as a court, appeal from the action of which could be had to tho dis- trict conrt of this county, was not conclusive as to the validity of the claim; and that un- til that judgment or claim was an adjudication thercon had, in ) such as the district court, no eriminal ould be maintained. attorneys for the defense in the I25th Massachusetts, whero a man who had put in im to the city of Lynn for personal dumages sustained by a tall on a sidewalk, made false representations to tho city attorney, and thereby induced him to confess judgment for a stipulated amount, and sccured the money thercon, was after- wards a ed for obtaining money on false t developing that he had not been injured on a defective sidewallk. He was convicted, but the supreme court roversed the case on the ground that the criminal charge could not be maintained until that Judgment had been set aside on tho ground of fraud—in other words, until a court of record had made adjudication thereof. Judge Strode finally decided that he would: not rulo on this point untjl Monday, but tomorrow he would hear “arguments and allow the submission of authorities on the motion. The taking of evidence would meanwhile procecd. The importa of this point will be seen by the faet that if it is held well taken by the court the stato will be compelled to gis- miss each and every indictment against Betts, Lauer, Dorgan, Hubbard and Sewell. This afternoon Dr. Hay, superintendent of the asylum, was called and testified as to the methods in vogue at the asylum as to checking up supplies reccived and what checks were used on contractors, everal Burlington railway conductors were called, but their testimony was unime portant.
