He smd that he knew Mr. Clark to be personally opposed to the giving of the Union Pacific guaranty bond to the city, bindimg that road to allow all other roads to cross on reasonable terms to this side of the river, but the Unmon Pacific president had nevertheless instructed the witness to car all the requirements of the coutract with the city in reference to the union depot. He said he was personally willing to turn them over, but he did not think it would be proper for hita to act in the matter without instruc om the board Mr. Howe then again took up the phase of the matter which is based on the idea that one of the reasons why the Union Pacific was mwilling to go ahead” with the depot under the old plans was that they called for a building that would be partly located on the ground of the B. & M., whereas as a matter of fact they wanted the whole thing on the ground that hus been supposed for years to belong to them, and in fact does so belong except for the city's equity in it Mr. Kimball showed where the buildings salled for by both plans would come with refercnce to the dividing line and the plat as introduced in avidence.
