| ; OMAHA DAILY BEE: Prosident of the Defunct Oapital National Bank at Liberty, ALL LOSSES LIKELY TO BE MADE GOOD It Me is Not Sentenced to Tmprisonment His Kelations Will Provide Sufclent Funds to Settle All In- debtedness. LiscoLy, Neb,, Feb, 2.—[Special to Tue Brr.]—At 10:15 o'clock this morning a bond signed by C. 0. Whedon, the attorney and zonfidential advisor of C. W. Mosher, presi- dent of the defunct Capital National bank, and promising to pay to the United States government £10,000 in case Mosher should not appear at the first day of the May term of United States district court, w filed with the clerk of that court. It bore the approval of the district attorney, Hon. Ben Baker, fnd 4 few minutes afterwards Deputy Mar- shal Melick informed Mosher that he was free to go where he pleascd. He lingered around the hotel for some time, an last started in acabto the southeast, presum ably to his home, A petition is in circulation today, and has already been sigued by a number of depos itors, praying the court to punish Mosher by fine only, and not to sentence 1t im prisonment. This is a beginning of a move- ment that has for its object the escape of Mosher from any incarceration. It has been authoritavively stated that if the depositors will agrec not to prosecute him they will be paid dollar for dollar, Mosher's sister-in-law and other heirs of the Mansfield estate in Peoria having g nteed to advance £200,000 toward this object. It is thought that amount will cover all deficit found to be due, and not cause the stockholders of the ‘bank any loss. Will Accept the Offer. Hon. Ben Baker, United States district at- torney, was busy today preparing his aff 80 that he can depart tomorrow for Californ where Lie and Mrs. Baker will spend a mouth king of the Mosher case Mr. Baker “Mosher's friends have made a propo- sition to me which I have scen fit to accept, provided that they act in good faith. In substance it is this: They propose to put up $150,000, and make good the 40,000 of small deposits if the sentence can be made @ fine instead of penitentiavy confinement Now the situation is just this: If we send | Mosher to the penitentiary his friends will not make good a dollar of insolvency and the creditors will suffer. On the other hand, it we illow them to put up this £150,000 it will almost 1ift the bank out of the hole and this money will go into the hands of poor people who can illy afford to lose a cent of their hard earnings. 1 don't feel like taking that money out of their hands. Mosher's fricnds are willing to pay this amount of money for the reputation of the family and 1 am inclined to let them do it for it will be just that much for the depos- ftors that could never be got if we sent Mosher to the penitentiary. But the men who make this ~ proposition must act square in the matter The uctual cash or its equivalent must be dep ited to the credit of the bank by Mosher friends or he must go to the penitentiary for 10t less than five years. Other Features of tho Case. ‘There is another matter that leads me to wish for the postponement of Mosher's sen- tence for a few months. Mosher has in- sisted on taking the responsibility entively upon himsclf for the wrecking of the bani It would be rash, I think, to rush him off to the penitentiary without waiting to ascer- tain if there are not others responsible for the crookedness as well as he. 1 have left the matter in such a shape, with my deputy, that if Mosher's friends fail to put up the money they have agreed to, then his sen- teuce can very well be withheld until the May term of court, and in the mean time ‘we may be able to understand more about the causes that led to the failure of the bank. If Mosher has told me the truth he is not guilty of so grave a_crime, morally, a8 most people have been led to suppose. He 8ays that the benk lost $100,000 by failvres of smaller banks the very first year of its exist- ence, and that he kept othis” fact from the knowledge of the stockholdders, for, being resident of theconcern hedid not wish to see t go down and he feared that if he would reveal the true state of affairs the stock- holders would become discouraged and the credit of the bank would be ruined. He cov- ered up this loss as best he could, shifting the securitics about so as to make it appear that the bank has a paid up capital of $300,- 000, when as a matter of fact it had but §200,- 000, for the other $100,000 had been sunk. He continued to make the bank pay dividends on £300,000, while he worked with a capital of only §200,000, and finally the strain became too great and the crash had to come, Mosher's father-in-law is very rich and he is willing to come to the front with the $150,- 000 to save the reputation of his son-in-law. 1 think that1s a pretty bigh price to-pay for a family reputation and when a man is willing to do it Iam inclined to think that it would not be right to refuse him the privilege, seeing that the money will go to people who need and aught to have it."” District Court Nows, Owing to the fact that the supreme court adjourned until week after next without handing down a decision as to the validity of the drawing of the grand jury, the cases against Laver and Hubbard, thé ex-asylum steward and farm boss respectively, vehich were set for hearing today, were continued for two weeks, Les Gamble, charged with stealing A. L. Shader’s bicycle, plead guilty this morning to grand larceny, but William Clarke, his paruier, thought he wasn't, and the case went over until afternoon August A. Reuting, the flying machine in- vestor, was arraigned on the charge of set- ting firo to a Union Pacific bridge, Ho pleaded not guilty, and secured a continu- ance until next Tuesday. Charles Brown pleaded not guilty to two charges of forgery, and remanded until o date for trial could be arranged. John Patterson and William Winninger, charged with grand larceny, were aArraigned and pleaded not guilty. * Their trial is in progress this afternoon, Charles Hoppey, the chap who was ac- cused of ronbing' Loomis' hardware store withdrew his plea of not guilty and acknow edged that ho dia the Job. It cost him si toen months at hard labor in the peniten tiary Ed Norton, charged with assault with in- tent to rob, pleaded not guilty and trial was ‘set for Monday. Joe Murphy and John Ryan, same offense, pleaded not guilty and will have a trial Friday. Thomas O'Neill, same offense. said he was not guilty ; trial Monday. Legnl Struggle for Possession of the Russell Children Still Going On, The fight for the possession of the Russell or's court iin yesterday afternoon and was con- tinued with all of the old time vigor until the children broke loose in Judge B hour of adjournment caused a cessation of hostilities. At the start the court made a ruling to the effect that in the future, or at least until the final disposition of the case al- d to see and converse with the children, and that those conversations should be held only the father and the mother should b low in the presence of the sheriff. That was the signal for war broke loose. ~ Mr. Halligan, the a Mrs. Russell declare that Russell had been at the sheriff’s residence trying to the children to make an afidavit to the effect that their mother traveled ina very rapid class and that she was not much of a mothe after all.
