Shoemaker, who was at that time mssistant city nttorney, and upon trial in the district court was convicted wnd sentenced 1o three yoars inthe peniteutiary. The case was appealed to the supreme court and the decision is the one received vesterday. Dur- fng its peadency, Koen was released from confinement undor bonds after haviug served about two mouihs of Lis sentence, and for the past Lwo or three months hias been en- joying the sweets of loerty witn all the relish of an ndividual who knows what it is 1o be deorivea of it The first ofticial notico of the action of tho supreme court in the matter was recoived yesterday by \W. S. Shosmaker, in a lotter from Altorney General Hastiugs, which stated that inasmuch as the hizher court found that it had not been proven that the paper in which the libsious matter was printed was a paper of general circulation tho offeuse was not @ felony, and there- foro not pusishable by imprisonment in the penitentiary, but that it was proper that a lesser seutence should be imposed, and advising that the defendant Koen be at onco taken into custody before the decision was made public. Accompanying the letter was a copv of the mandato of tho court, and Mr. Koen was \mmediately looked up' and looged in jail.
