Shea the Victim of Des- perate Highwaymen, SEVERELY SLUGGED AND INJURED Suddenly Assaulted by Three Toughs While Enroute Home In the Ieart of the City—Will Not Hold Maher, The sluggers and garroters aro not all locked up. A party of three of them were abroud lust night and found a vieum in At torney J. J. Shea. Me. Shea lives on South Eighth streot, between Fourth and Fifth avenues, and no left his ofico in the Merriam block shortly after U o'clock to go home. .He went down Fifth avenue, one of the best lighted streets in the city, and when he turned the corner to go up Bighth street he noticed three mon standing in the full lare of the electric hignt. As he approached them they circled around him and one of thom shoved a revolver under his nose and bude him throw up his hands, The attorney thought 1L was some of ks friends trying Lo play a good-natured joke upon him, and bo laughingly replied that he would do so but that it would not do any good for he did uot have anything they wanted. The joke part vamished when the fellow with tho gun ropeated the order with a flood of infunity and un admonition that no fooling would be wolerated. Mr. Shea is a six footer and a mau of courage and tho thug with the pistol was surprised and staggered by a blow under tue eur that knocked him down, but before the uttorney could follow up the ad- vautage gained he was felied to the earth by a blow from a sandbug in the hands of an- other of tho trio. 'ho _blow struck shim in tho side of the head but only partially stunned him, and the thugs were ‘continuing 1o siug bum when ho begged them noi to strike him again, ana told them he would eivoup aud thut they tight have ail be possessed. T'hen they carefully searched his pockets ana found nothing of value excepting o fino lady’'s gold watch and chain belonging to Mrs, Shea. This they took, and after giving bim a parting kick and an admonition to lie stiil or chiey would kill him they left, dis- appearing 1 the adjoining alley. The rob- bery was committed right under the electric liglit that is swung across the street, wittin 100 feet of Shea's residence. Shea gives a partial description of the thugs, One was a tall man, the other a medium sized fellow. heavy set, and the third was a smaller man, When they were out of sight Shea got up and went to his residence, when he was in- formed by his wife that three fellows had been looking around the house and bad stepped out on the walk and went down tho streot towara the corner where they met Shea and took him because he happened to e the first victim that appeared. The blow from the bludgeon that fell across the attorney’s heaa produced a large bump and a thumping headache. After the robbery Shea followed the rob- bers to the end of the alley east of Kighth street on Fifth avenue and saw them disap- vear in the darkness on their way north- ward. A hack driver camo along at that minuto and Shea dispatched him to tne police station to notify tho police, while he stood guard over the end ot tho alley. Fortunately for the thieves, however, there was no ono at the other end cf the alley, and they found no difficulty in emerging from it into the wide, wide world, leaving behind them scarcely wace of their identity. The coronet’s jury that has been Investigat- ing the causes ot the deatn of Jack Wade for tho past three days completed their labors yesterday afternoon, little evidence being in- troduced in addition to that already pub- lished. At the conclusion of the evidence there was some discussion between the mem- bers of the jury us to the way in which tue verdict should be made out, but it was finully decided to leave it ambiguous as to the question who fired the shot that laid Wade low, and the following was finally adopted as a verdict suMfciently ambiguous to suit all the parties concerned: “An nquisition bolden at 14 North Main street, June 1, 1892, before F. T. Sey- bert, coroner of said county, upon the body of Jack Wade, there lying dead, by the jurors whoso nauier are hereunto subscribed. The said jurors upon their oath do say that Jack Wade cume to his death by & pistol shot wound from a pistol found in the pocket of W. M. Jones, and that the shot was fired in defense of the life of said V/. M. Jones. “In testimony whereof the said jurors have hereunto set their hands this day and year aforesmd.” This verdict in effect settles tho question of what shail be done with Maher. He is still confined 1n the county jail, but no in- formation has been filed against him, nor has any churge baen placed opposite his name on the register at tho police station, 1t was the wish of the suthorities that as much time for investigating as possitle be given, and thoy accordingly decided to wait uutil the verdict of the coroner’s jury shouid be ren- dered before mukiog any formal charge against him, His case will probably have a heuring 1n police court this morning, but be will undoubtedly be disch. o County Attorney Orean stated yesterday afternoon, after hearing of the verdict, that he did not see how any caso could be maude ag t Maher, and this opinion is shared by almost all who have watched the progress of tho testmony introduced at the inquest, That no more evidence has been introduced that would tend to make Jimmie Maher out to be a murderer is quite a disappointment to many who have watcaed him in Rl e of crime and wondered how he would finally turn out, but the police were unable to find auything that would establish his guilt, As it was well put by an attorney who has peen more or less interested in the case, the same providence that looked after George Washington seems to have scen to it that Maber should Lot get into avy trouble so deep that Le couldu't get out. ‘Mz, Jones rested comfortably yesterday aod felt quite well almost all day. The defense in the case of the state against Pyburn and Hodson, the East Omaha mer- chants charged with obtainicg money under false pretonses, took a change of venue yes- terday from the court of Justice Cones to that of Justice Hammer, and a continuance was granted at their request until next Sat- urduy. A new information was filed against Py- burn, charging him with perjury. The in. formation alleges that the perjury consisted in the amdavit made by Pyburn and filed in Justice Cones’ court alleging that Ed Shaw had been present when tho trade was made between Coyle and Pyburn & Hodson and would swear that Pyburn and Hodson made rosentations whatever as to the noto with which they had paid for Coyle's stock. The warrant was served upon Pyburn while he was in the court room. He gave bail at once in the sum of $300, and was released pending a heariug on Saturday. Another information was “tiled, Charles Fisher being made defendant. He is charged with stealing two show cases, two barrels of lamp chimneys, and some othor aricles, all belonging to Mrs. Jerome, from the store at East 6mnhn, which has caused so much trouble recently, and brought them to this side of the river. The stolen property was alloged to bo worth §75. His bona was fixed av 500, and on furnishing this amount he was released and will bave a hearing at the same time with the rest of the partics to the transaction. e Sickness Among Children.
