The provisious of the will are very particular, They aro in substanco as follows: To Mrs. Von Holtschuberr, his sister, ko bequeatbed the lot near the “Q.” depot on which the Balliogall restaurant stands, a splendid pieco of property, also a half interest in the hom o which she has always occupied, all notes and uccounts due bim, all stock in the Wapello County Fair association, and the coul palace and $7,500. To the city in which ho took so much pride he bequeathed what is known as the Ballingall hotol property worth at_ tho most conservative estimate’ 5,000, also tho Magnolia rostaurant and the acrd of ground on which Is located tho picklo factory, also lots 7, 8, §, 10, 11 and 12, bettor known as the larger portion of the Sunkon park, on which tho conl palaco stood. Tho bequast is to be held as a trust fund, three trustees to be guardians of said bequost, only two of whom may belong to tha same _political party, and these shall be selected by tho city council of Ottumwa, to hold oftice for threo years, ono belng clected each year. Theso trisees aro to seo that tho Baliingall notel is perpetuated a8 a hotel forover, and after insurance and the requisito repairs and improvements aro made annually, tho proceeds are to go into a sinking fund of §20,000. After this sui_has been reached another sinking fund of 6,000 is to bo created for the Library association exclusively, and thoreaftor all proceeds from the bequest and from the sinking fund of $20,000 shall go to the following: One-fourth to tho Library association, one-fourth to the poor and needy of the city, one-fourth to the various religious societies of tho city and ono-fourth to a fund for tho erection of & foundilugs’ hospital, To tho Libraty association, besides the $200 aunuity aiready mentioned, s bequeathed tho second lot of the Sunken park for a_site for a library building, 1f the society shall buila oue. Harrow, secretary of the Johnston Ruffier company and County Attorney Thomas A. Walsh. Cause of the Contest, The contest is made by Mr. Hodge and Mrs, Von Holtschuherr, The former is a wholesale hquor dealer, for whom the late colonel provided in a generous manner whilo alive, assisting him 1 his financial ventures and bequeathing him all the obligations owing the deceased at tho time of his death. Mrs. Von Holtschuherr is the wife of Count Oscar Von Holtschuherr, whose recent mar- o has already been extensively noted. She was her dead half-brother’s favorite sister, and after the death of her first hus- band, Mr. Phillips, became a momber of the colonel's household. She manifested much business tact and was very successful 1n var- ious lines of business in which, with tho aid of her brother, sheembarked. ' Asshe is aiso one of the executors she is both prosecuting and defending. The third heir, Mrs. Mary Thomas, has disappoared, and her relatives do not know whother sho be living or dead. Sho married somo fifteen years ago against her parents’ will, Her marriago proved to be an unfortunate one. She gave birth to two childron, a boy and girl, and while thoy were yet infants she migrated to Colerado. About six years ago the late Colonel Ballin- gall received a letter from his sister suying that on an incoming train would be her son Bert, then but 5 years of uge, The boy was properly labelled “Ottumwa,” and arrived safely. " That is tho last intelligence thoy ever received from her. Letters have been written and inquiries made, and when the death of Colonel Ballingall w known, no- ticos were sent to all the Denver papers and other Colorado papers that she might recelve the udings and make kuown her where- abouts.
