CONDITION OF THE CITY SEWER SYSTEM Exhaustive Report from the Engineer on the Subject of Public Sanitation—Mem- bers Tangled In Regard to Deals Ing with a Veto, The ofclals of the Union Pacific Rallway company evidently didn’t know that tho city council was loaded when it conceived tne fden of erecting a boiler shop fifty-five feet high across the foot of Cass straet and on the proposed Iine of the west approach of the Nobraska Contrai Railway company’s bridge, but when they learn of the action taken last night they may change their minds in some respeots, The business of the council was being ransacted without a bitch until Mr. Munro introduced this resolution : ¢ Whereas. The Unlon Pacific Rafiroad com- pany hus obtained apormit from the Inspector ot bulldings to construct a boiler shop. Laid Over One Week. Mr. Chaffec urged that the resolution should be referred to the committee on streets and alleys, and that the eity should not be hastily plungnd into a law suit. Mr. Eisasser suid that the resolution should be adopted. The city attorney would not plunge the city into a law suit without 1t Was nacessary to protect its rights. Mr. Edwards wantad the committee to have vower to act and it was given. Thoe report will come back to the coancil next Tuesday night. Mr. Munro again went after the Union Pacitic Railway company with this resolu- tion, which was adopted : Whereas. The Unlon Pacific Rallway com- pany_now is and been collecting moncy for rental from the American Water Works company for the use of ground on which said WALOE WO combuny’s pumping station in the vicinity of the foot of Cuss street is lo- cated; and Whereas. The new Omaha Thomson-Houston Elec- tric Light company accepted the proposition of the council and agreed to place thirty- eight additionzl arc lights at $140 per aunum each to burn ou an all-night schedule, The company also agreed to make the same price on tho thirty-two arc lights now in use which are in adaition to the 100 provided for under tho original contract. Tho city attornoy was instructed to pre- pare the necessary contract, The registers who will sit prior to tho special election to be held for the purpose of voting upon the bond aquestion wero ap- pointed and the appointments confirmed. ‘The fecs of the judges and clerks who will serve at the special election were fixed at $6 for the entire time and services, providing the county comumissioners concur’ and agree to the price. ‘The city attorney was instructed to pre- pure an ordivance defining the duties ot the commissioner of health, properly belongs to Omuibus Improvement Ordinance, An omnibus ordinance providing for the fmprovement of a number of strects was in- troduced, read twice and referred. This ordinance catches all of the streets whero contracts for paving were awarded by the Board of Public Works with a ten-year guaranty clause, City Attorney Connell said that he hoped that the suits in wich the city was enjoined from paving Fortieth street and cther streets would be settled. Thero wero two ordinances introduced, creatiug two additional city offices. Oné ordinance was for the purpose of creating the oftice of legal agent ut a salary of §75 per month, His duties are to collect evidence and work under the direction of tho city uttorney. The other new oftice is that of ofiicial reporter of the city council, with ® salary attachment of $125 per month. The reporteris to stuy in the mayor's office from 9 a. m. until p, m. of each day. He shali also attend all meetings of the city council and moke @ shorthana report of all proceedings. As soon as practi- cable he shall make and furnish 1o the mayor and each councilman a com- plete abstract of all that has transpired at the meeting. The veto was sustained. Thon the mayor vetoed the contract with John Grant to'pave Park avenue with as- phalt at §.05!4 per square yard, The mayor said that the prico wis excessively high and that it was better to delay the work than to allow such an injustice to bo practiced upon the taxpayors, On roll call Mossrs, Bechol, dish, Chaffeo, Edwards, n, Lowry, McLeario, Munro ana Mr. President voted 1o override the veto, but befors the vote was announced the members cnanged their votes and the voto was sustained, all of the mer- bers standing by (he mayor, Then the fun commencod. Mr. Lowry moved a reconsiaeration of the vote and Mr. Chaffeo got Lo the front with an able second to the motion. Mr. Klsasser raised the point that a voto on a veto could not bs reconsidered. The president held with Mr. iSlsasser, but tho council did not. Mr. Chaffee, just to test tho sentiment of tho council aled and tho ruling of the president was knocked out by a vote of 12 to 4. Mr. Lowry then moved that the rules So suspended and the vote whereby the veto was sustained bo recousidered. 1'bhis went through by a vote of 13 to 3. Then the question came up again on tho veto of the mayor and that veto was rejected by a voto of 1210 4. There were soveral merabers !who had some doubts about the logality of this action and thoy importuned City Attorney Counell to toll thom just how the matter stood. Things is Mixed, Mr. Connel! stuted that he did not want to antagonize the council, but he thought mat- tors wera in bad shape. Tho coun- cil had instructed the chairman of the Board of Public Works to reaavertise for bids for paving tho street, and ho doubted whether tho contract could be legally ap- roved after that action hud boon takon. In act, he said, the whole thing would bo illegal and void, and any taxpayer could prevent the colloction of tho tax Lo pay for e pav- ng, Mr. Chaffeo wanted that opinion 1n writ- ing. Mr. Connell wrote the opinion ana submitted it to tho council. 1t was ap- proved, only three membors voting “no.” At this point Mr. kdwards movea to re- consider tho vote by which the mayor's veto was rojected. The motion provailed, three members voting in the negative, This resulted in the mayor's veto coming squarely before the council, and again 1t was sustained, Mr. Chaflee alone voting *no.” Right here is whero the council got back at the Board of Public Works. Heretofora it has been the custom to instruct tho entire board to act, but by Mr. Chaffee’s resolution, which was adopted, Major Furay and Cotonel Egbert were ignored because the chairman was instructed to invite bids for paving under the specifications for 1892, but with a five-year guaranty on asphalt and brick and @ one-year guaranty on ull classes of stoue. Routine and C ing. The mayor sent another veto to the coun- cil. It was on the resolution to repair Spaulding street with vitrified brick at the intersections where tho block paviog had washed out. The resolntion failed to state the amount that would be required to make the repairs. ‘Phe veto was rejected by o voto of 14 to 2 In addition to this the mayor vetoed the or- dinance ordering the improvement of street improvement district No. 440, Tho ordi- nance did not state the nature of the im- provement and the veto was sustaned by a unanimous vote. Tho secretary of the park commission served notice upon the council that a doal was pending by which the city mizht come into possession of the Clark tract of land for a park on thesouth side. City Treasurer Bolln asked for a burglar- proof safe in which to keep the valuabies of his oftice. Tho Crane Elovator company was in- structed to havo tho olevators ready for operation as early as Junc 1. If not ready at that time the city attorney is instructed to begin proceedings. Thomus F. Godfrey was appointed and confirmed as assistant boiler inspector, but he will be paid by the insurance companies that asked for his appomntment, Tho ordinance providing for the levying of fines of uot less than ¥ and not more than $200 on gambling houses was read three times and passed, A resolution instructing the heads of de- partments to hire rasidents 1 preference to nouresidents was acopted. Rboden, living four miles south of this aty. Mr. Rhoden was in a field at work at the time and his wifo was alone, She visited the barn, and as she emerged therefrom was caught in the arms of tho tramp, who placed his band at her throat and threateningly com- maunded silence. She faiuted and was car- ried into the barn by the villain, He was about to carry out his desigos when the lady’s husband appeared on the scene, hay- ing returned on an errand from the fleld where he was working. He hastily secured a pitchfork, and as the tramp escaped from the door he hurled the pitchfork at him, but without the desired effect, and the villain escaped, The farmer then turned his attention to his wife, whom he with difficulty brought out of the faint and she was nearly paralyzod with fright, and at the present timo is suffer- g from nervous prostration, brought on by the groat scare she oxporienced. Last even- ing Mr. Rhoden was in South Omaha to secure the services of a physician and related the story of the attempted outrage to a Bre representative. He hopes to appretiend the tramp, that justico may be meted out to him. Considerable time was taken up in agrocing upon the intevior arrange- ment of the building, The building is to be a frame, two stories in height and in size 40x100 feet. Located on the first floor will be the fire department, police headquurters jail. On_ tno ‘sccond floor will be oficials, the polico court room and chambor, The latier will be com- bined and the room will bo in sizo 20x40 feot. The estimated cost of the building is €5,000. Officer John Van Wie has been appointed night captain to succeed Captain MceMahon, removed. ‘Cho appointment is regarded as a good one. ‘The removal of Captaia McMahon was not unexpected, aud was caused by the chango in the administration.
