It has already had one trial, a jury having given ajudgment in favor of the plaintiff. The zompany then filed a motion for a new trial, which con- tained some rather strong allezatious with reference to the court, and procured for the attorney who filed it a vigorous roasting from Judge McGee. The motion was sus- tained, however, and yesterday the second trial camo off. When the plaintiff rested his caso it was found that the suit should never havo been brought agalnst the Burlington road, but against the [Kansas City, St. Josoph & Council Bluffs, if any 'one. Tho court uccordingly took the case from the jury and returned & verdict for the defendant. A T'ne buriden of tho solo work fell ipon Mr. George 5. Holmes and Mrs, Torrens. Mr. Holmes' bass is not_particularly heavy, but it has considerable richness, especially i the lower register, and he bandled it with con- summate skill. He sang with fine spirit and threw o dramatic exprossion into his tones that was_exceedingly effective, His work was admirable througnout, and won frequent euthusiustic applause, While Mrs. Lorrens' singing lacked some- what of the force and verve which a stronger soprany might have thrown nto the part, especiully whien brought into eontrast withi the virilo tones of Mr. Holmes, she hus a sweet, trained voico with flute-liko upper notes aid sang in fine taste, She severdl times won the tribute of hearty applause aud was complimented with o beautiful basket of flowers passed over the footlizuts, Mrs. Katharive Fiske was prevented from reaching Omaha by a washout on a railroud, and her place was tuken by Miss Kenncdy without preparation. There was & sugges- tion of timidity in Miss Konneay's livst notes, which was eutirely excusable, but she carried hor part thereafter with such ability and intelligenco that one can bardly sup- press & mild surprise that it should bave been thought necossary to send out of town for a vocalist for the part, Messrs. Wilkins and Treynor really had minor parts, and, wkilo it is possible to con cewve them sung with more spirit, these two soloists maintained their reputations and did acceptable work. Misses Clarkson, Popple ton, Bishop und Amsden appeared in soveral quartettes and trios, and it is not too much 10 say that their efforts wera among the most artistic aud pleasiug of the evenlng. Le work of the cuorus was particularly worthy of notice, and in its excellence is Director Torrens' praise. T'he chorus took its first number with an attack which prom ised well, and the bope was not disappointed.
