Neb Savings Banks Offisials Reply to the Cir- oular of Bank Examiner MoGrow: CASHING CHECKS FOR THEIR DEPOSITORS Alloge That the Law Doos Not Clearly Deaw the Line Between Savings and Com- mercml Business—-New Law Needed, s | Bankers doing a savings business in Omabta aro somewhat oxasperated at the action of State Bank Examinor MeGrow, who, in a report to the state banking board, said that many of the savings banks of tho stato wore doliborately ovading tho pro- visions of the state banking law. By bis investigation Mr. MoGrow said he found several of the savings banks doing & WIS | FAULTY commorciul business by issuing and deliver- ing to their customers blank cheoks, shghtly different in form from those used by com- mercial banks. By conaucting this kiad of business the banking law was ‘evaded aond savings depositors ran groat risks. Mr. McGrew also recommended to the board that all savings banks not adhering to the law should be deemed unsafe and should bo closed up. The question now is, according to the bankers, “What s the law?' “Whoisto defino it!" Some of the financiers say that MeGrow calls ono thing commercial business when they do not. John . Wilbur, cashier of the UmahaSav- ings bank was seen by a 3kr reporterin re- gard to the alleged irreguliarities of the sav- ings nstitutions. tle said that he thought Mr, McGrew was going off half cocked, and that he was acting too hastily before a suffl« cient investigation could be made, “It is un casy matter forn bank exatminor," said he, “to see whother or not a savings bauk is doing a commercial business, and ho should mako it do either one kind of business or the other. The banking department has jumped uvon us about exchange, checks and receipts, but admits we do as unear a savings business as possible. A new law, similar to that ‘of Minnesota or Micliga passed defining clearly tho duties of commeor- cial and savings banks. A savings bavk, iv is true, should not be permitted to do a com- meroial business as it is unsafo and. jeobara- izes the interest of a dopositor on account ot the difference 1n the eapital stock required and the manner in which the two loan money. 1 do not consider that we dp 4 'com- mercial business when we receive or ohsh a check or bill of exchange., For instance, John Smith is working for a firm which pays him monthly $100. He makes it a point to save $25 a month of that amount ana is doing business with us and deposits that each month in our savings bank. Say tho firm for which he works does business with a national or commercial bank and, pay Smith his earnings in a check on ono of those banks., Now, do yoa think that he is going to one of those ‘mstitutions, look up some one to identify him, get his check cashed and then walk perhaps a' half dozen blocks to come to the savings bank where he does business and then deposit the $25! Not much. Smith will go to his savings bank, get the $100 check cashed and leave the §25 deposit. The bank oxaminer calls such transactions commercial busin. Jt is not, and we don’t regard it as such, 1t is simply an accommodation to a customer. Wa must do this. Then there are savings de- positors who leave their passbooks with us, and when they have to pay out money issue a chock if they can’t leavo their business. This is not considered commercial business among bapkers, but it seems that the bank examiner thinks different.” “Tne difficulty,” remarked W. H. Russell, president of the Dime Savings bunk, every b.nk examiner undertakes to coustrue the law in a now way. Thelaw is indefinite. Under the term savings Sank, as the law provides, shall be included only'such banks as do a savings business exclusively, paying out mouey on presentation of passbooks and certificates of deposits, aiscounting and buy- ing no commercial pape! but_there's nothing in it saying savings banks shall not receive checks. Buving or discounting paper is altogother different, and is allright. In its crude form the law leaves 00 much for the imaginativn by not saying what it intends to convey or cover. As to the form of check cr receipt lot the bank de- partment attempt to say what we shall usa and it will tind that it has no authority by law to prescribe anything of the kind. As faras our bank is concerned no commercial business is being transacted,” Arthur Metz, teller of the German Savings bani, said that no check business was done in his bank. All passbooks had to accompany them if thev wera issued. He further said the bank did a commarcial business, but it was entirely separato from that of the..sav- 1ngs department. “I think the suzgestions offered by Mr. MecGrew,” said John Rush, president pf the Nebraska Savings ana Exchango bank, “and the lines drawn by hiwm for savinzs banks to follow should be strictly adhered to, -~ As far as I know, the banks of Omaha havo never infringed on the rales laid down in the bank examiner’s circuiar. We do both a savings and commercisl business, and under the bead of the latter wo issue checks and drafts. This has nothing to do_ with the javings bank department of our institution, Doxter L. Thomas, cashier of the same bank, said that he knew of savings banls in Omaha practicing the business complained of by the bank oxaminar. Ho knew of .cor- tain savings institutions that retained pass- pooks ana cashed checks on them. By this action he statod that ho could see no iu]ury being doue as money was simply paid out on receipts which were nothing more or less than nogotiable checks. e He sald: ‘“My love I am sorry to disap- point you about tho picuic, but my trottor bas a lame foot.”” That's nothin We've got plenty of Salvation oil, The Detroit Iree Press Fiond has boeen punving on Dr, Bull's cough syrup.
