WILL OFFER IT FOR PUBLIC SALE Present Settlers and Squatters Will Refuse to Yield Their Clatms and Will Fight the Case | the Courts, The recen t decision of the supreme court of the United States in the suit brought to settlo the question of the boundary line be- tweon Nobraska and Towa, or at loast that portion of the boundary lLine affecting the East Omaha Land company’s possessions, instead of quicting the titlo of lands along the river, has added any number of now com- plioations, some of which may nov be settied without there being serious trouble and pos- sibly bloodshed. Just at this time the question of .who owus the greater portion of the land in section 35, township 16, range 13, is at issue. Going down into ancient history, in 1856 the Missouri river claimod the groater por- tion of this section 36, which is located just outside the city lmits in the vicin- ity of Florencoe lake. This same stato of affairs existed whon the original government survey was made. The lana was platted as fractional lots, and so remaimned. Settlers kept away from it, regarding it valueless on account of the nearness of the river, Clalmed by the State. ‘When Nebraska was admitted into the uniton, sections 16 and 30 in all of the town- ships were declared school lands and set asido to be sold,the proceeds to be used in support- ing tho public schools. At the public sale which was held the lots in section thirty-six, township sixteen, range thirteen, wore offered at public auction and sold, Subsequent to that aate the river had gradually receded, leaving o wids bo.tom lying east of the land originally surveyed, and in ascertaining who owns this tract is what will cause the trouble. ‘The purchasers of the land in section 36 claim the tract under the laws of accretion, and point to the decision in the East Omaha oase as settling their title for evermore. They hold that the same law applies and that they have by this decision acquired title to a 1arge body of land which 18 now very valu- able. Bat this not all. As the river receded during all of the years since 1850, squatters, with an eye o business, have watched and waited, and while so doiug have settled upon the land lying between the original survey and the present channel of the stream. There are bhall a aozen of these parties and they hoid that their title 1s the best that can be obtained, as they settled outside of the meander lina of mo_ survey of 1356, and at the time they made their settlement thers were no con- flicting interests, The state did not claim the land, neither did the purchasers of the fractional lows 1n section thirty-six. Thus the matter rested, all parties foehng happy in the possession of what they honestly be- lieved was their own. Probably they might always have enjoyed this feeling of security if the stato had not taken a hand. Not long ago Colonel Humphreys, the state commissioner of public lands, learned of the existenco of the tract of lund formed by accrotion and at once requested County Sur- veyor Smith to survey and subdivide the tract iuto ten-acre lots. “Mr. Smich oveyed and in running s lives discovered about 200 acros of land. This fact was veported to the commissioner of public lauds, who at once declared that the lots and lands wero the property of the state. They did not belong to the original purchas- ers of the lots 1n section thirty-six, nor did they belong to the squatters. Ho' also de- clared his intention of selling the land at public sale and turning the money into the hool fund. Squatters WIll Contest. When this information was conveyed to the parties holding possession there was a commotion in the bend of tho river. The squatters declarea that they would not re- movo uniess they wero forced cut at the point of the bayonet. The original purchasers of the fractional lots had nothing to say until they learned of the court decision In the East Omaba case, sud thon they rose up in arms. 'They de- clared that the land was theirs and that thoy would hold possession until tbe crack of doom, land commissioner, state und squatters to the contrary, notwitbstanding. The original purchusers of tho fractional lots, or at least most of them, have held their lands for speculative purposes, while a few have put on permauent improvements. Squatters have plowed, sceded and har- vested, They have built their homes and invested their all and now declare that they will die in_their own blood if their homes are sold, or if they are removed without belug compensated for their years of labor in opeuing up their farms.
