EVIDENCE OF HIS ALLEGED CRIME WEAK Nothing But n Confession Will Conviet i of the Marder of the Colorado Ofeer—iis b Is Bad - Local News Not A telegram was received at the polics headquarters yosterday with recard to Joe | McDermott, the Boston store burglar who s supposed to be wanted in Deuver for the killing of a policeman by the name of Phil lins, The telegram was signed by the Den- ver chiof of polico, aud stated that unloss McDermott had made a confession be might as well be discharged, as their cvidence against him was not complote and thoy were afraid they could not make a case. Several Omaha detectives were at the county jail yesterday morniug, and beld u con versation with MeDermott. They showed him a tin type which was unmistakably his, and which was accompanied by a card offer ing n reward of £1,250 for his arrest. He admitted that the picture was his and that the reward had boen offered for his arrest, but said that he had already been arrested once for the crime and been ordered released Ly the Denver officials, as they had decided that he could not be convieted, and had wi: drawn the offer of reward. Officers Luuch aud Wells, who made thearrest, had aa vis jons of champagne suppers dancig bofore their eyes ever sinco tley heard thata ro ward had been offeved, and were thus doomed to disappointment, along with their numerous friends who had counted on sharing tha sup pers witn them. Clark and MeDarmott wers both identified by tho Omaba officers s being tough cus tomers. Clark is thought to be a_ brother of the notorions “Dink” Wilson, who ic wanted for being implicated inthe Glendale express robbery, and there is certainly a very strong resemblance between him and the photo- graph of Wilson whicli was seat out by the St Louis authoritios after tne robbery. MeDeroott_has already confessed that he robbed the Boston store and admits that the police have a clear caso against him. Itis probable that both the men will enter a ploa of guilty when their cases arc called for trial. When court adjourned his bonor stated that there would be no court on Monday, aud he thought it advisable to call their attention to the ino- structions which had been gven at he opening of the case with reference to their behavior toward outsiders, especially in view of the reports that badjbeen brought to him by some of the officers of thecouct. The substance of these reports was that the men bad been ongaglug lu conversation with cer- THE tain parties who were interested more or les directly in the case on the merits of the ov dence. This had to be stopped at once and he gave them a number of bits of aavice o guide them in getting rid of troublesome feliows who might be inclined to force their opinions upon them, His remarks croated something of a sensation among tho bystand- ors, as well as among the jurymen, aud al- though no names were mentioned some sly romarks were dropped here and there tuat showed that quite a number had been watching the maneuvers of one or two individuals who have been greatly in- terested in the progress of the case. Among those who have attended tho trial is a mem ber of the police force, who has bsen sitting where ne could got a commanding view of the whole situation day after day.
