ERROR IN THE COUNTY OLERK'S RECORD. Seventy-One Thousand Dollars Worth of Bonds Fell Due Six Months Before Expected * reasurer Snyder. A numboer of the court house omlals wete s0 surprised yesterday that their nerves wero unsteung for sevoral hours. Some twenty yvears ago, no one seeming to remem. ber tho ‘exact date, Douglas county voted £250,000 of bonds to aid the Union Pacific railrond and the Missourt river bridge com- pany in constructiug a railroad and wagon bridgo over the river at this point. The vouds were for &,000 each, payable in twenty years, and have been drawing inter est at the rate of 7 per ceat por annum, pay- avle annually. Since that timo the county has always paid the interest and has reduced the debt by the payment of §12,000 of principal. The officials have always supposed the balunce of the bouds will become due and payuble January 1, 1802 and with toat understanding, they inended as soon as the next levy is made to make some provision for taking ip or refunding the bonds. Tuey gathered their iuformation regarding tho bonds from the entry in the boud register, made twenty vears ago. This entry states that these donds, describing them, “will be due Junuary 1, 1502 Standing upon this record, County Trea urer Snyder a few days ugo_sent the July intercst to Kountze Bros., w York, the holders of the onds, and at once official notified Auditor Evins that the interest h been paid. That gentleman felt satisfied, as he felt that he had & county ' debt off s hands for six months at least. This fecling of security aud satisfaction was suddenly dispelled” yesterday when a man from the First National bark walked into County Treasurer Snyder's ofice aud olly remarked, “Can you take up these and pay me £i 1,000 Snyder thought it was a joke, and didn’t propose to huve any fooling, but soon discov- ered his error, as seventy-one 31,000 bonds, vable July 1, 1501, were spread out before hunderstrucic, the o lled Auditor nto the room, and a moment v made a raid_on County Ci to secure the bond re This book shows that the bonds are due next January, but the bonds, on their fuce, carr: the mation that they are five days past due. The trouble all comies ubout on account of the error upon the part of the county oficials who registered bonds twenty years ngo. At the next meeting of the board some action will be taken to provide for the care of the paper, and no serious trouble is liable to arise, as the commissioners understand that Kounitzo brothers are anxious to refund the debtand carry iv forten to tweaty years longer. sem that It Travels at the Rate of Sixty Miles Per Hou Tue Ovaua Bee, on Sunday, in the west- ern, northwestern, and many places in the southwestern part of the state, reaches its readers from eight to twenty-four hours ahead of all its competitors. In fact, whon the lutter reach their destination they ure like back numbers. They are not used for reading, but for wrappiag ana carpet pad- ding purposes. [n cach of these respects they are quite valuable, How is Tue Bee able to so distance its competitors ¢ Bosause it has established a number of horse routes throughout the state! Because it has its own special train which makes a run to Graud Island, 154 miles dis- OLD-CONTRACTS CANCE Claimants Frebd by Congress From Exactionsof Shark Agents. Tt is perfectly nataral of course for the claim agents and peasion sharks of Washing- ton to try to hold tiseir business and to con- tinue to exact exoeitant fees from partios who have claims of any kind against the national government, or who have applic: tions pending for pensions or patents, Claimants have been awindled for years but there is no loager any excuse for thoir being subjected tothe sharp and swindling practices, Partics who had contracts with claim or pension attorceys prior to the last congress are now at liberty to revoke such contracts and to renew their claims or applications through Tite Bee claim bureau, and thus sc cure prompt und proper attention at the min- imum cost fixed by the W, r'he last congr a speetfically and annul all existing contracts ~between claimants and attoroeys in_the Indian Dep redation Act of March #, 1501, This is a fact which any one iuterested may read for him- self by’ applylg to the Examiner and Tue Bek burean for copy of the law. Possibly the eminent con stitutional lawyers and jurists in_the senato and Louse of ‘representatives should have consulted these obseure claim agents before pussing the et which so seriously curtailed their Shviock propensities. But more re- liance was pliced upon the recent decision of the United States supreme court, case of Mitehell vs, Clerk, reported in 110 United Statet Roports, paye 6.5, wherein the highest triounal in the land asserts: “No provision of the constitution prohibits congress from interfering with the validity of contracts." The second lewal problem involved is that of revccation of powers of attorneys. When and under what cireumstances can a_claim ant recall an existing power and employ an otner attorney ! One of the attorneys quotes Judge Storey “When an authority or power is coupled with an interest it is from itz own nature and character, in contempla. tion of law 1rrevocable,” And then he pro- ceeds to argie that the retaining of an attor- ey on a contin t fee is equivalent to ing the power with an interest T'nis statement is absolutely false from a zal standpoint, but it is an assertion well caleulated to mislead the ordinary reader., Whiat is really meant by an “interest’ is an interest or right in the thing itself. Thus, if an estate is conveyed to a trustee, with powe sell, this power cannot be revoked becausc the trustee has an interest in the estate itseif; he holds the legal title on the property. Again, if the owner of a one-fenth of it to u second party, and gives him a powor of attorney in counection, said power of attorney cannot be revoked be cause the assignee has an interest in the patent itself. But if a climant gives a power of attorney to an agent to prosecute his claim on 4 contingent fee, this power is not coupled with an interest, and can be re- voked at the pleasure of the claimant, When tho ageut agrees to work on a con- tingent fee ho necepts as o very serious part of the ‘‘con the possibility of ving his powor revoked. And u feo ¢ uton the successful prosceution of a yean in no way be construed as an “interest” ju the claim which would render a power of attorney irrevocable. — ——— Soothing Syrup for chil- ioves the cnild from pain.
