Judge McGee Renders an Important Decision Against the M. tor Company. An important decree was handed down McGee, 1 the case of Maria Juckson against the Omaha & Council Bluffs bridge company. The caso is important, not because of the amount in- volved, but because of its being a test case, which will virtually decide a score or more of others, The'suit was brought to compe motor company to pay about #150 for paving between company’s tracks in front of the plaintifi’s property. The attorneys for the defense combatted the claim on tho ground that the roud had besn built under the old charter of 1866, 1n which there was 10 provision for the pavng between the tracks. Askwith of the law firm of Wright & Baldwin was summonea before Judge McGeee yesterday morning to answer to a charge of coutempt of court. The charge arose from a little occurrence which took place in the superior court on Thursday af- ternoon. Quite & number of attornevs and others were present when court convened this after- noon. They evidently felt considerale inter- est in the outcome of the battle whici was ocing waged between one of their number and the court. After a fow matters of minor importance had been disposed of, the con- pt matter was called up. George Wright and John N. Baldwin were on the field to 100k after Askwiti's interests, Mr. saldwin handed Judge MeGee o paper which contained Askwith's statement, The Judge read it overand then gave bis statement of tue case. He said that if u court was to allow attorneys to challenge it to come out into the buck alley to settie disputes, the court wight as well be abolished entively,and the back-ulley style of settlement be adopted in the fiest place: Mr. Baldwin claimed that the court had 1o right to impose the five, as the court had uot been i sessiou at the e of the oc- curreunce, Judge McGeo was not moved by the attorney for the defense, and ne ordered that Askwith be contined in the dounty jail for ouo day. ! A number of the property holders claimed that the use of the right of way was practically abandoned and brought suit to compel the “present comvany to remove its tracks. Aerial navigation hus been agitated for hundreds of years, and in proportion to the time, talent and money which has boen de- voted to it, less has actually baen accom plished than with almost any other scientitic or mecha problem to which serious and earnest attention has been directed. Tt is quite natural that the utmost curiosity should be aroused when an inventor declares that he bas ut Jast_overcome all obstacles, ana_has constructed a ship that will successfully navigate the air at a speed of 10) miles per hour, und at all times be under the ubsolute control of the operator. “Tuese are the claims made for the Chicago air ship that will be exhibited next Sunday at the fair grounds, when Prof. King w make a number of ascensions previous to his sail to Chicago, which is annoauced to tuke place at 4:30 n the afternoon. To have an idea of what the air ship is like all that is necessary. is to imagiue a large cigar floatiag 1 the air supporting a small boat. The sustaining portion of the ship is sixty feet long and about thirty feet in diam- eter, tapering to a sharp poiut”at each end, and has a cap of about fifteen thousand cubic feet of gas.” Ordinary coal gas has a lifting power of ‘about th vo pounds to ach 1,000 feet while hydrogen gas has double ' that power. Hydvogen will be used Sunday to iuflate the buoyancy chamber, and it will be generated with a portable gas machine at uce of inflation, water, sul- phuric acid, zine and iron filings and a few other chemicals being all that is rve- quired. Attached to the lifting part of the ship is a wicker basket or car eight feet long by four feet wide. On each side of the bas- ket are lurge wings or fans, capable of being enlarged or made smaller, and lowered or raised to any angle or position by simply manipulating two bandle bar “These fans or wings control the steering of the air ship and exerl the same influcnce upon it that a rudder does upon a steamship, In front of the car is located what is styled a wind divider, ullt upon such a plan that very little resistance is offered to the air dur- ing a flight through space, At the rear of the car is situated the propelier, made of papier mache. This is op- erated by a dynamo of two-horse power located in the forward part of the car, The dynamo also drives the balance wheel, a queer looking arrangement fastened on tho bottom of the basker. This wheel resembles a hollow corkscrew partially flattened out.
