Stone filed an amended petition 1n the district court yesterday in the case which he commencee agaiust the city to reco damaged on account of a change in the grade of the street. The case had a partial hearing before Judge Thornell at the last term of court. Mo ran a saloon on Cut-off 1sland for o time and one on Twelfth street in Omalia up to about three mouths ago. His saloon there was a popular vesort, but it bore a tough reputation with the police. About o months ngo he closed his place there and moved to tais city and started up a sa- 1oon at 714 Broadway and this, 100, has borne a hard na Itis known as the St. Klmo and lias been headquar v all sorts of disreputable doings. Beagle was a printer and he worked in a numberof priuting ofices on the other side of tho river before ho had gone into the saloon business, As soon. as the shot had been fired Dr. Bellir ger was notifled, but before e a 1 on the scene Boagle had breathed his last, Coroner Waterman was also summoned, and by his orders the body was moved to the un- dertaking _establishment of wW. C. Estep, where an inquest will bo held this morning av 10 o'clock. When the body was lifted from the bed the vall dropped upou the sheet aud was picked up and Kept by the underta It had evi- lently come from the huve Smith & Wesson which was lying by the side of the deud man, It had entered the left side within au inch of the nipple, and had come out of the right side, about six inches farther down, and about six inches from the spine. Last evening, afterinvestigating the affair, the police came to the conclusion that it might not have been a suicide, after all. Ofticor O’'Connell was detailed to work up the case. He made o thovough investigation, but owing to the different and ofton contra! dictory stories which were told by the neigh- bors about the affair. but little was_learned It was found that there was no powder mark ing around the wound, or on _the undershirt which the dead man wore. This fact, it is thought, is good cevidence that the gun was fired from a distance. Another thing that causes some suspicion is that thero are pow$ der marks on the right hand of thé dead man, between the thumb and the fore finger. The theory of those who be- lievo that he was the vietim of foul play is that hie was attacked by someone with' the gun, and that he made a grab for the weapon just as it went off, catching the charge of powder in the hand. 'One of the neighvors stated that she heard Beagle say a few sec- onds bofore the report of the gun, “Oh, for God’s sake, don't do that,” Who the Shooting could be laid to, providing it 18 found that the case is not one of suicide, is hard to tell. Mrs. Beaglo and her husband, it is stated, have quarrelled a good deal of late, and some are of the opinion that the shooting was the outgrowth of their quurrel. District Court News District court was occupied yesterday with the trial of the case of Krueger against the city. Krueger sued the city for $10,000, which he claims as damages for the death of his wife. It is alleged that Mrs. Krueger fell on a defective piece of sidewalk at the corer of Main street and Washington avenue, that had been unsafe for some time, and had been allowed to go without being re- aired by the aeglect of the city ofticials, She afterwards died. Monday night the ae- fendants filed a motion for a more specific statement, and this was argued by the attorneys and submitted. Yesterday morning it was overruled by Judge Deemer, The defendants then filed a demurrer, and this was overruled. The jury was then em- pannelled, and the trial was proceeded with. The defendants claim that the death of Mrs. Krueger was not caused by the fall, as it did not take place until & year and a half after the fall was had. All the day wastaken up with the evidence on the side of the plaintiff, and still there's more to follow. A warrant was issued in Justice Hammer's court yesterday against a fourteen-year-old son of William Boartz, charging him with committing an assault and battery on & nine year-old daughter of Charies Adams. Young Boartz, it is claimed, picked up a brick and threw at the little girl, hitting her in the eye and inflicting o terrible wound, The boy had gone fishing when the warrant was_is- sued, and he was nov arrested until last evening. Tonight Hepburn made a statement to the press to the effect that the iuvestigation reveals a shortage of $400,000, ehargeable to a former president of the bank.
