The controversy —arose over an attempt to foreclose & mortgage on the Chicago, - Kansas & Nebraska road. Mr. Erb decides in favor of the Rock Island. He finds the terest was in default and that the trustee had a right to_foreclose the mortgage and sell the road. The case is one of great importance, and if the report of the referee be accepted, it means a 1oss_of 1,000,000 to the counties of Kansas and Ne- braska through which the road passes,. to- gether with a_loss in dividends due and which the Rock Island will escape paying.
