W. Worthingtou for illegal voting at the general election in November, 1858, was called in the county court yosterday afternoon at 8 o'clock. It is doubtless remombered that O, S, Jones pre- ferrod the charges. Back of it, however, is the fact that the complainant had Worth~ ington arrested at Montrose, Ia., some six months siuce for uttering forged paper. He failed in his proof and the prisoner was dis- charged. Subsequently Worthington sued Jones in the United States court for dam- ages for falsearrost and imprisonment. To provent o transfor of the case to tho state courts Worthington filed an afidavit citing the number of years he had lived in Tow a and that his stopping in Lincoln in 1856, oft and on, was due to the fact that he was wanted here as a witness in a case 1n whieh his father was an interested party; that he was here solely for that purpose, and never hud lost his residence in that state. The affidavit was noted by Jones, and he cast about for evidence that would criminate his man. It occurred to him that Worthing- ton had voted hero at the general election, und search revealed tho fact that the poll books furnished the proof. Judgo Stowart took the matter under advisement for o short timo and then held him to answer to the district court in $300 bonds, which the accused furnished. The District Court.
