Bow the Terms of Those From the New States Will Bo Fixed. ‘When Senator-cleot Pettigrow, of South Dakota, said the other day,in speaking of the lottery which will be held in tho senate to detormine the classification of the new members from tho northwest, that he would have no objection to drawing the short term, as he would be sure of re-election, he probably spoke by the card, boing well acquainted with the legislature with which he has to deal, says a Washing- ton special to the New York Evening Post. Other mer before him, however, have cherished n like idea and been disappointed. The theory is that, if & legislature has sufficient confidence in a man to elect him once, it will ropeag tho operation when it has a chauce. The man who gets n two-yoars’ term is scarcoly warm in his soat—he cortainly hus oot had time to make record and offend anybody—before the samo legistatura which clected him is called upon to- choose his successor. Whatis more natural than that it should choose him for a second term? Fifteon times since the original classification made immediately aftor the adoption of the constitution, has a senator from a new state drawn the two- years’ term; but in five instances the logislature haschosen somebody clse for his successor. In 1790 Theodore Foster was elected from Rhode Island, and drew the lot for the short term, and the legislature sont him back the next year to suceeed himseif. In 1792.John Brown camo as a senator from Kentueky and repeated Mr. Foster’s experience. Less fortu- nate was Willinm Cocke, who cago from Tennessee in 1796; for, although, when his term expired on the 8d of March, 1797, the governor appointed him to'serve during the recess of the legislature, that body, on meeting again, promptly elected somebody olse to succeed him. In 1812 Allen B. Magruder was chosen senator from Louisiana, but gave way to another the following year. In 1818 Ninian Kd- wards came from Illinois, and the fol- lowing year was re-eloctod, The samo was true of John Holmes, made senator from Maine in 1820, and of A. H. Sevier of Arkansas, elected senator in 1836: of Sam Houston of Texas, alected in 1846 of A, C. Dodge of Towa, ole 1 in 1848; and of Isanc I>. Walker of Wis- consin, elected in 1848, But then the luck changed again. John C. Fremont, made senator from California in 1850, went out to stay in 1851; and Shields of Minnesota came in .in 1858, only to go out in 1859; and Delazon Smith of Ore- gon had asenatorial term which is one of the briefest on record, lasting only from ebuary 14, 1859, to March 8 in the same year—a period of seventeen days. Finally came another tide of for- tune, and Thomas W. Tipton of N, braska. elected senator in 1867, was re- elected by the same logislature, as was also Henry M. Teller of Colorado, els ed in 1876, The forms which will with the new senstors in classifying them are very simple. As the senate stands now, there are twenty-six moem- bers with six years to serve, twenty-five with four years, and twenty-live with two. The first state which comes in, therefore, will have to divide the short and the medium terms between them. Phis will be done by the two senators drawing two paper’ lots, approprintely numbered, which will restore the equilibrium of the senate. When the next state appen three lots will be propured, and each of the senators will draw one. The remaining one will then be united with two more, 5o us to make up a set., and the senators of the third state will draw. The one that remains after t drawing will have added to it a lot containing the number of the class still lacking a member, and the senators from the fourth state will di- vide, these last two between them. Precedent has established pretty well the manner of proceeding where the gituation is more complicated than at present. For exampie, if the senate nuinbered eighty members, there would Dbo twenty-seven of each of two classes, and only twenty-six of the third ciass. ‘Where such a case has avisen before, the practice has been to mark one lot with the number of the class which 1s deficient, and put a blank in witht. The two senators then draw. The ono who draws the marked lot is classified ccordingly, whilé he who draws the blank is given three lots to draw from next, ngtead of being arbitrarily as- signed to the top or the bottom of the list.
