MASTERMAN, The Oase Oomes Up For Hearing in Justice Wade's Conrt, The case of the state vs. Albert Mastor- man came-up for hearing in Justice Wade's court this afternoon, Tho first witness called was T. G. Maguire, who owned the saloon at which the shooting took place, on No Man’s land, on September 8, His testimony developed nothing excent what was related in these columns at the time, Masterman had been knocked down in the afternoon while trying to preserve order. Maguire ca him into the saloon and told him to stay tho mo time after- ward he heard shots outside and looked out of the door. Ho saw the flash of a pistol and immediately closed the door and went the back door. He saw Masterman sitting down, surrounded by the crowd who were striking and_kicking him. He did co any ono shot. I'he next witness was one of the men who was shot, He acknowl: iged that he was roaring drank and did not remember anything_except that he was shot in the left breast above the nipple. He thought he was about six or eight feot from Masterman when ho was shot. Did not know who shot him. Iid not remember using any_strong language, or saying any- thing at ull to Masterman, _Acknowledged having had trouble with Masterman the revious Sunday, Masterman was put on the stand next. Ho testified that he had ordered Vandersloot off the danco plat ount of his usimg obscene language and trying to run every: thing. They refused to go and_threatened to do himup. About dusk Vandersloot came over to Maguire’s_from another saloon and s soon as he saw Masterman ho called his crowd and said they were going to do lim up. ‘They attacked hun and ho retal- iated by shooting. He shot first at Vander- sloot, but did not know who he shot at after- wards, After tho second shot he was knocked down and fired three shots while on his back on the ground. They were arrested and taken to the police station and confined in the same cell.
