Precisely the same eviaence was introduced in each case, with the exception of that of the de- fendants, Williams was put on the stand and convicted, while Somers was not sworn, and was acquitted. Their success was not very flattering, as every one of the aldermen ex- vressed himself as obposed to the move. Said a barber yesterday : “We are quite positive that the council will not help us, and we will have to depend on enforcing the state law. Those proprie- tors who are opposed to the closing move have all called on the councilmen and asked them to refuse our request. They kicked so hard that the aldermen will do as they wish. Wo are not very mich dissappointed, as we have expected ail along that this would be the result. We will make our first move a weel from next Sunday, and all proprietors will be notified through the papers that they wmust keep closed on that day. Then, if they open, they will be notificd personally, and if they then refuse to close, they will be prose- cuted under the law. It will be kept up, and there will be no Sunday work allowe in any of the shops. We are satisfied with the outlook and have not weakened at all. In district court, yesterday morning, the case of state vs Copeland was submitted to the jury at 11 o'clock, and 1a about thirty minutes a verdict was returned finding the defendant guilty of larceny from a building in the night time. The prisoner attempted to steal a bolt of black silk from the store of Beno & Co., and was arrested just as he got outside, The next case called was that of state vs Rowe, who was charged with the larceny of a watch from one McVeigh, at the farm of T. W. McCarger. A revolver und £2 in money was also taken. The watch was found at a pawnshoo on Upper Broadway. The case was submitted late inthe after- noon, and the case of state vs Williams and Somers was then commenced. The defend- unts are accused of burglarizing a residence in Loveland. In the south court room Judge Thornell heard a motion to modify the order of the court in the contempt case agains Frainey. The defendant was ordered make good the shortage of about $2,700 in ms accounts us udministrator of the estate of B, B. Frainey in one week, or submit to incarceration in the county jail. An appearance bond was given, and Frainey was released, Since that ume he has been on Nebraska soil. Yesterday his interests were represented by N V. Gannon, of Omaha. The aflidavits of Frainey and the boud for appearance were m g, and could not be found. The motion was taken under adyisement by the court. Durmg the afternoon voth Judge Thornell and Judge Carson were engaged in probate business, in the office of the clerk of the court. This evening Judge Thornell will leave for his home at Sidney, and during the forepart of next week, will hold an adjourned term in Fremont county, returning here the latter part of the week. S SN s Badly Scalded. A serious accident occurred yesterday morning at the home of J. B. Sadowski, corner of Nincteenth street and Third ave- nue, Mrs, Sadowski was lifting a pail full of bolling water from the stove when she stumbled, and the contents were thrown upon her little daughter, Bessie, aged four- teen months, and her niece, Pearl, aged five years. Both children were frightfully scalded, and the older one was in quite a serious condition when Dr. Cleaver arrived. The upper portion of her body was one great blister, and there were two serious burns on her lower limbs, The injuries of both were attended to, and applications made to reliove the smarting and pain of the burns. Boyle attempted to prevent. her, and in the squabble that ensued, Mrs. Ryan claims she was struck, and Boyle iusists that he was merely parrying a blow from Mrs. Ryan, but did not strike her. The sewerage question is growing to be of more and more importance ta Councii Hluffs, Many of the citizens do not raalize the dim- oulty of the problem, the solution of which is daily becowing wore and wore of a neces: sity. Where shall the sewerage empty! How shall it be disposed oft Those who re- alize to some extent the necessity for reach- ing some practical solution of tho probiem dread to tackle it, and the majority treat the matter with indifference. Av present the sewers empty into the creek, or sewer ditch. Where does the sewer ditch empty itself? The creek loses itself some distance south of the city. There is not enough of & fall in the bed of the creek and diteh to keep the sediment from acoumau- lating, and constant dredging at prosent seemns the only prevention from trouble. Already tho bottom of the creck is 1o many ’|l|m(‘u above the flow line of the sew There is nothing to prevent the water back- ing up into the sewers. Thus the sewers are fast becoming in such condition that they can not ompty themselves, jeveral remelies are suggested by those who have been studying the problem. One is 10 open a ditch from where the creek now loses itself to the river, a distance of about a mile, and by keeping this cleared allow the sewerage to empty into the river. It is claimed that there is a fall of about twenty feet between the city limits and the river at low water mark under this plan. High water would back up and necessitate a clear- ing out of the debris and sand thus brought into the bed of the ditch. Another sugges- tion is thata pumping system be provided, by which the sewage may be raised to an el- evation which will enable it to run off. Any of the numerous suggestions made in- volve the expenditure of a large sum of money, and this feature of the matter doubt- less causes much hesitancy about the agita- tion of the difculty. The growth of the city, the increase of sewerage, the extension of the pipes, are all tending to hasten the day when the dificult problem must be met, and it seems that the sooner the facts are squarely considered the sooner will some 8o- lution present itseif. Birkinbine En- ng and Supply Co., 115 Pearl ouncil Bluft The Polic Henry Johnson, alias Stewart, the colored man who assaulted Officer Doyle on the evemng of May 30, had his preliminary ex- amination yesterday afternoon before Judee Aylesworth, A number of witnesses were examined on each side, the prosecution cor- roborating the story told at the time of the occurrence, and reported in the papers, while the plea set up by the defense was that Doyle and Johnson had quarreled frequently regarding o certain prostitute named Elda Wheelock, and that on account of the bad blood existing between them, Doyle was the aggressor, and first attacked Johnson. Witnesses testified positively to seeing Johnson make the initial move, and that he pounded the officer unmercifully, while the utter was unable to defend himself, and did not strike Johvson at all.
