The action against Julius S, Cooley, who was eharged 1 a complaint sworn to by at Ford, which was tried in polics court Monday, for obtaining a man to cast an ille- gal vote, was postponed until Wednesday afternoon on behalf of the state, who asked for time to look np authorities to submit in their argument. Defendant’s counsel showed the maliciousness of Pat Ford in filing the complaint, and how Ford’s friend, Solon,had offered mot to have Duboise arrested if he would return and_vote again for od him (Frank Solon) Duboise £ for his v Tho with- yuke which Judge IBeria gave to the complaining witness, Pat Ford, in summing up_ the evidence is in substance as follows: “Phere is not a_particle of evi wduced by the prosecution to show that the defend- ant, Julius S, ¥, or tried o do what th g 'y wit- ness sswore to in the complaint. nor is there any_evidence from the same source that Duboisc voted illegally. The newspapers seemed to favor the removal, or at least several of them did. A few promi- nent citizens, and one in partioular, informed him personally that he favored the move, and now it seems that his mind has been changed, and he with the others vigorously denounce the removal of the fort as an irre parable injury to the city of Omaha. As there was no opposition in the beginning, one would no doubt take it for granted that the citizens in general, business men and all, were i favor of the removal. Congr will not meet again before the relocation is ac- complished, and unless a demonstration on the part of the citizens of Omaha is made, foreibly objecting to the removal, the fort will of course be removed. This demonstra- tion must be made right away ot a mo- ment must be lost. It should” be a strong, decisive opposition.
