That THE PATRICK LAND COMPANY of Omaha, a corporation duly organized under the laws of the State of Nebraska, in consideration of Elevren Thousand and Fowr hodred Dollars, fv hand paid by Hewry W. Pennock, of Douglas County and State of Nebroska, and in further consideration herein mentioned, and that the said Henry W. Peanock, his heirs, administrators, exccutors and ase signs shall truiy and fully comply with and perform all the provisions and conditions herein contained, do hereby grant, bargain, sell, convey and confirm unto Henrg W nnock, subjectto said provisions and conditions, the following described Real Estate situate in the County of Douglas and State of Nebraska, to-wit: All of lots one (1), two (2), three (8), four (4), five (5), six (6), sceen (?), eighl (8) wine (). ten (10), and eleven (11), i, k one loidred and teenty (120), in LUNDEE PLACE, an addition to the city of Omaha, as su d, platted and rccorded. Together with all the tenements, herodita- ments and appurt, 23 1o the same belonging, and all the estate, title, claim or interest of said THE PATRICK LAND COMPANY of Omaha, of, in or to the same. TO HAVE AND TO HOLD the above described premises, with the appurtenances, unto the said Ienwry W. Peanock, and lis heirs, executors, administetors and assigns, forever, subject to the following provisions and conditions, to-wit First:—The said premises shall be occupied and used for residence purposes exclusively for a period of at least fifteen years from the date hercof and for no other purpose whatever. Second: No residence or dwelling house or other building shall at any time within said period of fifteen years be erected or kept, wholly or partly, on any lot hereby conveyed, within tweaty- five feet of any street line bordering on such lot or lots. Third: No residence or dwelling house shall he ereeted or kept on said lot or lots herehy conveyed, at any time within said period of fifteen yoars, costing less than twenty-five hundred, ($2,500.00) dollars, exclusive of other buildings and improvements on said lot or lots. Fourth: The promises hercty conveyed shull never during said period of fifteen years be used for any immoral or illegal business or occupation; nor shall any spivituous or malt liguors be sold or bartered away on said premises during said period of fifteen years. Fifth: And the said Henry W. Pennock, heveby agrees for himself and his hoirs, executors, administrators and assigns that said THE PATRICK LAND COMPANY of Omaha, its successors or assigns, or any person or persons for the time being owning any ot or lots in the said Dundee Place, shall ve the right (and such right is hereby rescrved) at apy time during said fifteen years, to obtain from any court of competent jurisdiction, an injunction mandatory or otherwise, to prevent a breach of any of said conditions hereinbefore enumerated and to compel the observance of said conditions by said Henry W. Pennock his heivs, executors, administrators and assigns, and in addition to such remedy the party or parties aggricved by any such breach may recover damages therefor the same as if there were no such right to an injunction: And in of a hreach of any of the said conditions by said Henwry W, Pennock his heirs, rcutors, administrators or assigns, said TH PATRICK LAND COMPANY of Omaha, its successors or assigns shall the further right (which right is hereby reserved) at its or their option to declare a forfeiture, and thercupon tho said premises shall revert to and become the property of said TIHE PATRICK LAND COMPANY of Omaha, its successors ssigns, and it or they may enter upon and hold the same and the title thoreto, anything in this deed to the contrary notwithstanding. Sixth: Each and all the conditions and covenants aforesaid shall run with and bind the land hereby conveyed and every part thereof and be binding upon every person who shall bo the owaer thereof during said period of fifteen years. Seventh: -« By accepting this deed the said Henry W. Pennock hereby binds himself and his eirs, executors, administrators and assigns to observe all the conditions hereinbofore mentioned as fully as though e had signed these presents. Pennock and Zis heirs and assigns, that it is lawfully soized of said premises, that they are free from incumbrance, that it has good vight and lawful autherity to scil the same, and that it will warrantand defend the same unto the said Henry W. Pennock, his beirs, executors, administrators and assigus, forever, against the lawful claims of all persons whomsoover: subject to the conditions herein and subsequent taxes.
