THE OMAHA DAILY BEE THE KECKLEY-REAL CONTEST. All Difficultiee In the Twenty-Fourth District Amicably Adjusted. DOINGS IN THE LINCOLN COURTS The Water Problem at the State ““Capital-The Prwnee Railrond Crossing Trouble—General and Personal. 1026 PP Streer, Lixcowy, Oct. 2. The dificulty in the Twenty-fourth sena- torial district has been happily settled. Since the Fairmont convention matters have been somewhat warm in both York and Fill more countics, and the outcome did not augur well for republican success at the coming election, At the convention both counties presented candidates for nomina tion to the state senate and, strange to re late, each county ed the nomination of its man. Au uncomprom ising spirit for a time, and & democ ator |l|u|nhh‘ from two of the strongest republi san counties of the state. The York feilows, Howover, proposed to rest the scttlewent o the difficuity in the hands of the executive comtnittee of the republican state con committee, to which, finally, the Fillmore republicans consented, and, accordingly, last night was fixed for the hearing, the com- mittee agrecing to sit us arbitiators in the event that Keckley and Real, the would agree ‘to abide by the best judgment and decision of the “com Livcors Bureav or Tue OMana Bes, } Tho case was called at 10 o'clock p. m.. ra. This was sufficient at there was fraud or u mistake , and it was the clear sense of the therefore, u majority of the convention con tinued in session and Senator Keckley was declared renominated, having received a ma of the votes of the assembly entitled wvote. The York delegation came before the committee with the aflidavits of eleven stating that condition of ision was accordingly wor of Mr. Keckley. The en- ngs of the couvention were in ular order. There was o dispute what ever as to this point adjustmen and that Se phantly re-clect WANT THEIR MO The Aefunct insurance company of Lincoin by James H. MeMurtry, receiver, commenc suit against the Insuranco Company of Da- kota, of Sioux Falls, to day, to recover com- missions due the plaintiff on cancelled poli- cies. It seems that when the Lincoln com- pany became insolvent an agreement was en- tered into with the defendant to tale up and cancel volices running on unexpired time, and allow a commission of per cent. There has been a radical break in the agrecment, ‘The Dakota company went in on the deal with avidity, took up a large number of poli- cies but failed to turn over the per cent agreed upon. Suit is therefore brought to recover commissions on divers premiums. Nellie Haskins, administrator of the cstate of Lyman Haski suit this morning against th , praying for a judgment of #5,000 damages against the city for carclessly leaving the sewer open into which the sed fell and forfeited his life, The petition in usual form al leges that tho sewer was left in angerous condition by the city authoritics, and that Mr. Haskins came to his death from no fault of his own William Leonard alleges that Henry Sullen- bach is due him in the sum of $100, and asks for judgment and costs of suit. William Clark institutes suit_against Henry C. and Ada Bittenbender and others for two promissory notes, one of which is secur and he seeks such may demiand, L. W. Billings Toy also secks cauity roliof John C. Rickets, and ho hsks tho forcclostre of & realty mortgage, its sale and reimbursement to the amount of $1.000. Tho district court docket has been increased at a lively rate ~-day. 5 THE CITY WATER PROBLEM. The most scrious question, porhaps, that ever agitated the public in the city of Lin- coln is that of the proper supply of good, pure water. For months past the water mains haye been fed by brine, wholly unfit for family use, and as nauscous as a dose of medicine when used to drink. The council has boen “cussed fore and aft" for suffering such conditious to exist, and the impressions of the traveling public have been anything but favorable, But there is a remedy now. Joseph BBurns submitted a proposition t0 tho city council last night. that promises a way out of the mud. He will bond himsaif to furnish the city with pure water sufficient for overy purpose and condition, at less than half the present expense. The proposition, of general iuterest to the public, is as fol ows Iwill supply the city with good, fresh water for the torm of twenty years, furnish- tng the water and all mac naterial and labor necessary to deliver the water in the city mains, the city paying me for the me in the following manner, viz: The city agreeing to take at lcast 1,500,000 gallons of water per day, which 1 will furnish as above described for the sum of 7 cents per 1,000 gallons for the first 1,500,000 gallons and 6 Vents per 1,000 for the next 1,000,000 gallons above that amount BETY H. A. Parker, general manager of the Rock Islaud railway company, denies that the order of the state board of trausporta- $ion has beeu violated at Pawnee City, ox- eept 80 far as it effects the crossing on’ But- der street. It is further stated that this street has been constructed since the com pletion of the road, and the approach to the crossing complained of is described as being acut about tweive feot below the surface and will ne ate high approaches on either side to comply with the order of the board. “*To comply with the order,” says the superintendent, “will be to jump from au into the fire." "He state: waiting for compliance with the ordoer to commence suit for dam- ages, and that the negligence of the company in the matter is due to the fact that iu_either event the road courts a law suit. It is a curious predicament if this condition exists. ‘Which! is the question, and the answer is in the bands of the Rock Island railway com- pany. SUPREME COURT PROCEEDINGS.
