A CLEAR CLASH OF OPINIONS, Jerry MHarrigan's Peace of Mind Greatly Disturbed By a Woman —Two New Exterprises For Lincoln. 1020 P StReeT, LixcoLN, August 16, Robert Luecas, complainant, vs the Fremont, Elkhorn & Missouri Valley railway company, respondent, comes be- fore the state board of transportation for consideration at the next weeting of the state bourd. Mr. Lucas sta for cause of com- plaint that the above named respondent f& 0 corporation organized under and by virtue of the laws of Nebraska, and owns and operates a railroad, which passes through the towns of Valentine and Norfolk, and that it owns and operates a branch line of railroad con- necting the cities of Norfolk and Pierce. And further, that complainant had six car loads tl at Valentine which he to ship to the city of Pierce, but that the respondent demanded for the trans- portation of the cattle the sum of $4 pr car; that the charge is unreasona- Ific, unjust and excessive, complainant alleging that the sum of #26 would have been a reasonable charge for such se vi alko, that complainant then shipped the cattle and was charged for such transportation the sum of $31.45 per car, or $188.70 for the six cars; that the charge of #31.45 per car from Val- entine to Neligh, a distance of 154 miles, is an unjust, unreasonable and excessive charge, and that #20 per car would have been a reasonable charge. Complainant asks an investigation and such decision as justice and cquity may require and restitution of all excess in charges. OPINIONS AT VARIANCE. A petition signed by a large number of the business men of Schuyler pray the state bourd of transportation us foi- lows: “Having understeod that the state board of transportation has ordered a reduction of freight rates throughout the state, notwithstanding the railroads made a concession in November last from (tariffs then in force of 33} per oent, we respectfully protest against the enforcement of the order and petition the board to recall the same. From the best information at our command we be- lieve the general public are all satis- fied with the November tariff, and we believe there isnotasingle com- plaint to the contrary before your hon- orable body. “We believe the tendency of a rigid obedience to your order will be tocheck all railroad construction in our stute and thus paralyze all new railway projocts. Capitulists are already alarmed, and Nebraska is black listed in Wall street as a state to be avoided when invest- ments are to bo entertained. If this condition of affairs is permitted to main, the onward progress and devel- opment of the commonwealth will be retarded for years, We believe that rates in existence prior to the fssun of your late order ave reasonable, just and Tair, and therefore respectfully Bolicit that the prayer of our petition be granted.” B But in the face of theforegoing potition comes one each from Howard and Hitch- cock counties, signed by 835 farmers, laborers and business men, endorsing the action of the state board, and de- claring that if the order is rescinded reducing freight tarifis they can see no escape from flnancial ruin. There is a clear clash of opinion, and the endorse- ment of the action of the state board is ten for to one against. JERRY HARRIGAN AND MARY BRENN Jerrye Harrigan is again in trouble. But Mary forgot the sacred promises she made the judge when arrested in April, and on Tuesday she entered the sacred precincts of Jerry’s home and declared it her inten- tion there to remain, Her wrongs and disgrace from the house of Harrigan had burned deeper wounds into her soul, and she said that she could not stay away trom the place that ought to shélter and protect her in her shame, and that it was cruel and wrong and unjnst for the court so to decree. Neither threats nor coaxing on Jo part could induce her to y's leave his place, and as his peace of mind was greatly disturbed by ber presence he came to town thismorning and swore outa warrant for herarvest for violating the conditions of the injunction. The warrant was issued by Judge Stewart owing to the absence of the judges of the district court, and an officer was dispatched to the country to compel Mary’s attendance at court 10 answer to the charge. The poor woman will have to go to jail or make very positive promiscs that she will no longer bother Jerry at his home during the life of the injunctior At the incipicney of the case the picture was man’s perfidy and woman's frailty, Now it is a broken heart, swaying and bending under the lash of public condemnation and a man surrounded by wealth and still possess- ing the confidence and estoem of his fellows. 8 NEW ENTERPRISES FOR LINCOLN, The Vitrified Paving and Pressed Brick company, with a capital stock of 100,000, which will engage in the busi ness of manufacturing brick, tile and sewer pipe, filed articles with the re- corder u) deeds yesterday afternoon. The incorporators are W. H. B. Stout, J. H. Buckstatf, A, W, Eandlaly, R. C. Penfield and W. W, W, Jones. The Lincoln Paper Manufacturing company and the Lincoln Saddlery company alsofiled articles of incorpora- tion. Each of these companies author- ize a capital stock of $50,000. The pa- mill is admirably located on South th street, and will occupy acres of land. The main building will _be 100x160 feet. Thoe articles of this company were John H. Lally, J, A. Buck- signed l?' 81 5. Utt, A, A. Buckstaff and W. W. Jones. The saddlery company will whelesule saddlery hardware, col- lars and saddles, and the business will he operated by J. A. and A. H. Buok- W. Long, C. Armstrong and W. Jones. PREPARING LABOR TISTICS, Mr. Jenkins, commissioner of the bu- reau of labor stutistics, is preparing his report to submit at the next meeting of the Nebraska legislatuve. He is going to the hottom of the labor problem and ‘other guestions he touches, and his work, which will comprise. a book of about three hundred pages, will prove of great benefit in shaping legislation touching the questions that come under his rench. He is especially interesting himself in immediate labor questions, and is bringing to his aid bureau re- ports from Belgium, Switzerland and England. His report will be exhaus- tive and more comprehensive than such reports usually are. ASSAULTED 1118 LANDLADY. A drunken brute by the name of Frank Barnes, assaulted his landlady, Mrs. Lou Pratter, last night about mid- night, on the corner of O and Ninth, kicking her down stairs and into the stroet and serving her little daughter in the same manner. The wretch was captured after a sharp run and was lodged in the city jail, where he now lies awaiting trial. It was a cowardly act and a dose of law should be admin- istered 1o him without stint. The Elks’ soctal last evening was a pronounced success, It was instituted and held in the social interests of the wives and *‘best girls” of the members of the society. The music was the prin- cipal part of the programme, and it was really fine. The ladies and gentlemen in attendance enjc one of the most pleasant evenings of the season in Lin- coln. The Nebraska Southern railway com- pany filed a series of by-laws with the secretary of state this morning. The articles of the company were filed some time ago, but the by-laws fix the of business of the company at Supc Nuckolls county. They simply cite common business rules by which to be governed. The following cause was filed in the supreme court this morning: Josiah W. Rogers vs George W. Sample and Lucian Wookworth; error from Doug- las county. Sam Clark, son of Robert Overton, was poisoned yesterday by taking an overdose of lye. The boy was two years of age. It is not known how he obtained the dose. His body was laid to rest in Wyuka cemetery to-day. Undertaker Heaton reports the death of four children during the past twenty- four hours, all of whom are to be buried to-dny. ‘The fatality among infant chil- dren of Lincoln has been very great during the past few days. Several politicians in the Stewart building were discussing the strange things that has happened in the lives, when Mr. John P. Boyle gave a circum- stantial account of a curious event that occurred twenty years ago, before the New York Central railrord began run- ning its cars into the unfinished Grand Central depot. “In 1869,” Mr. Boyle said, ‘“‘there was a sewer being constructed in Elev- enth avenue from Forty-seventh to Fif- tieth streets. The tracks of the Hudson River railroad ran through Eleventh avenue, as everyone here knows. In building the sewer it became necessary to shift the tracks, and the carth taken from the sewer was piled on either side of the excavation. “One day, just after noon, an old man whose name [ have forgotten attempted to cross the track at Forty-ninth street. The pile of dirt prevented his ing an approaching train. He got dircctly in front of the engine, and was cut to pieces before knew what hit him. We were all standing there and saw the whole thing. Before we had time to take two steps we saw something about the size of a frog jumping over the stones and dirt heaps. e followed and saw it stopped in the avenue between Forty-seventh and Forty-eight streets before the dead man’s house. On the subject of the oppressive heat in August the Philadelphin Times prints this interesting suggestion to laboring men and all exposed to the heat: “Those who must be exposed to the sun iu their daily labor should be specially careful to guard against sunstroke or the many other ailments which may come from sultry weather. The head should always be protected by a damp linen cloth under the hat, and a fresh cabbage leaf is even better than a damp cloth. Whenever the head or the stomach gives signs of weak- ness from heat, it is always wise to stop exposure at once, as such admonitions should be promptly vespected. Horscs should be protected by a little cloth shade over the ears, which will give a curreut of air over the top of the head where it is most needed. One of the methods often innocently employed to aggravate the effect of the sultry weather is the immoderate use of water or ice cold beer.
