THE OMAHA LINGOLN NEWS AND GOSSIP. A Peculiar Divorce Cnase Pending Before the Supreme Court, IN NEMAHA COUNTY. ‘What Hon. T. J. Alexander Has Bay of the Outlook in His Dise trict—New Notaries Coms missioned. POLITICS to 1020 P Starer, Laxcony. July 95 “Married or not married” must be a vexatious question, especially when the words have been spoken uniting one unto another and the same contract has been annulled by a court of competent jurisdiction. A case presenting this complication was filed in the supreme court yesterday afternoon. It comes on error from Gag unty. Moses B, and Sarah E. Wisdom are the plaintiffs and Ann E. Wisdom, by Virgil Chipman, her guardian, and Joseph K. Cobbey, her next friend, are the defendants. 1n 1484, at the spring term of the district court, the plaintiff in error secured a divoree from Ann E. Wisdom, the defendant in error. The sorvice was made by publication. Soon aftor the divorce was granted to him he married Sarah K. Wisdom, who is now joined in the action with him as one of the plaintifis in error. Since this marriage they have continued to live together as husband aud wife, Dut the suit which now brings theminto the supreme court was commenced over two years ago. The defendant in error, by Virgil Chipman, her guardian, filed a petition in the district court, the prayer of which was to set aside the decreo of di- vorce, that she might come into court and answer to the petition for divorce, ha her right to make this answer wupon the fact that fraud was practiced in procuring the LINCOLS BUREAU oF Tiik Ovana Bee, } decree, and alleging that at the time the de was granted the defendant was a feeble minded person and under guardianship, to which, of course, the laintiff filed a demurrer, which was eard, and leave was granted the peti- tioner to amend by making Mrs. Wis- dom, jr.,a party defendant. This rul- ing and amendment brought separate demurrers, and the petitioner again allowed to file an amended pot tion making a new party })l:\infifl, viz,, J. E. Cobbey, as next friend. Upon this amended petition no new summons was served. On the last hearing in the district court demurrers were again argued, but they were overruled by both Judge Applegate and Judge Broady at the mh and spring terms of court "of 1887 and 1888, respectively. This provoked the plaintiffs in error to refuse to make further answer to the petition and the court accordingly ren- dered judgment upon tho pleadings, as od, and the case is brought to the me court for review. NEMAHA COTNTY POLITICS. Hon. T. J. Alexander, of Johnson, Nemaha county, was in the capital city to-day. His personality is neither striking nor magnetic, but he drew a bevy of press reporters about him soon after his arrival. He had just come {from the land of Howe and Majors. This 15 why he was sought. “Anything new politically in Nemaha county?”’ modestly asked THE BEE man, as he drew near Alexander’s intelligent but angular presence. “Can’t say there is,” said Mr. Alex- ander; ‘‘the boys down that way are protty quiet.” *What's the slate, anyway, for the local campaign the coming fall?” "W\'\I,‘] shall stand upon my record in the house two years ago, and seck to be returned. John Pohlman of my pre- cinct, will try to down me, but his rail- road record is too well known to hurt me very much, McGrew would like to ‘be renominated but I understand that K. B. Hubbard,of Lafayette, will contest his chances,” *‘Hubbard is a pretty good man, is he not?” “One of the very best men in Nemaha county. He is for the people on every question.” “Whnt do Howe and Majors intend to do? “Howe says that he is out of politics, but I think that Majors would like to go back to the scnate. His record is pretty loose, and if he has to make a fight for the nomination I think the starch will all be taken out of him, Tom’s old census scheme is re- membered down that way **So Howe is out of politics?” **You can’t tell a thing about him, ‘When he is out, he is in, and vice versa, .yowknow. I think that Church has it n for Majors. They don’t lie in the same bed togother very long at & time. But I think that Howe will favor Judge Church for the senate, and that he will secure the nomination. The senator is conceded to Nemaha county and the float representative to Johnson county.” ORGANIZED AND INCORPORATED. The E. L. Squire Company of Omaha commences its corporate existence July 27 and will continne for a term of twenty years. The company posscsses all pow- ers incident to corporations under the Po-day the company's poration were filed with etary of State Laws. The com- will commence business with a be in- pan capital of $25,000, which may creased to $100,000 whenever business conditions warrant it. The following pereons congtitute the officers and board of directors for the first year: Ernest L. Squive, president and treasurer; Tlenvy C. Boynton, vice president and socretary; Ernest L. Squire, Henry C. Boynton and Jucob Sims, board of di- rectors, The company will do a gen- eral loan and investment business. SUTHERLAND'S COMPLAINT AN The following answer was sent to J, N. Sutherland, of Tekama, to-day re- govding hus compluint charging the Chicago, St. Paul, Miuneapolis & Omaha railway cumpnng with over- charges on gasoline freight shipped to him from Omaha: LANCOLN, Neb., Jnlx] 26.—J. N. Sutherland.—Dear Si ours of July 16 received and contents noted. When the board meets your letter will be laid before it. The matter ¢f your complaint is un inter-state matter over which this board has no jurisdiction. I think it reasonable and legal for the railroad to ship oils in barrels on estimated weight. The shippers should see to it that the barrels are full. This is my individual view of the matter without consultation with the other mewbers of the board, O. P. MAsON, Secretary Board of Trwszovu\uon. NEW NOTARIES PUBLIC. ‘The governor to-day commissioned the following notaries publio: Charles Moore, Sutton, Clay county; 1. P. Benedict, Leigh, Collax county; William M. Giller, Omaha, Douglas county; Julins W. Enlow, Beutrice, Guge county; Daniel P, Davis, Harr- son, Sioux county. CITY NEWS AND NOTES, Judge O. . Mason sought relief from business cares by going to Nebraska City this morning. He occasionally ‘gives his frionds down that way o day. Hon. John Peters, ol Albion, iy the city to-day. He confidently expects the nomination for state auditor, and serves due notice upon Colonel Tom Benton and other aspirants for the po- sition to this effect, 'he case of the state against William was called before Tudge Stow- morning. Gleason was arrested on last Monday for running gambling rooms in the Potvin block contrary to law. To suit his convenience for trial the cause was continued until to-day by his giving bonds to the amount of #4400, He was duly called in court this morn- ing according to law, and, failing to ap- pear, his bond was declared forfeited. Mayor Sawyer is not getting along as well as his [riends would like. The in- juries he received at the hands of Pot- re more serious than at first sup- poscd, but it is not thought that they will pr permancnt. The ma or's injuries about the hips are v painful, and he is reported somewhat worse this morning. About two hundred Lancaster prohi- bitionists went to Nebraska City this morning to attend the prohibition con- gressional convention. These cold water fellows “turn out” at their con- ventions and menageries, A delega- tion of Odd Fellows also visited the county seat of Otoe to attend a celebra- tion underthe auspices of a lodge of the order named, Dr. Nunnally, the T rs’ association n Jquor and Brew- an, of Kearney, enter- tained a large crowd at the government square last evening. New York Sun: The young maun had sat stubbornly in his seat for at least a mile. There were a good many tired women standing up in front of him, but he kept his legs sed and his arms folded and stared steadily into space. A flourishing looking business man crowded in. The young man touched his hat to him, and, springing to his feet, politely offered him hisseat. The seat was grufily declined, with the re- mark: “No gentleman could take a vacant seat while a lady stands.” N y ‘ered his seat to an nd as she dropped into it he crawled out of sight. The flourishing-looking man was a big v goods me wnt; the young man was one of his clerks. On one side of the car sat a glum- looking man who frowned and glowered at everybody within sight. He had looked pleasant enough when he first entered the car,but the stylishly dressed woman sitting opposite had stepped on his foot when she came in, and it had hurt the man so that he had said “d—" audibly. Pretty soon a tired-looking woman came in with a baby in her arms. She propped the baby up in a seat next to the stylishly dvessed woman, and then began” to read. The baby, after the manner of infants, struggled desper- ately to bite its fe ailing in this, the little one blubbered and frothed at the mouth and was just on the point of crying when it noticed a patch of glis- tening beads on the fashionable woman’s dress. The baby doubled itself up, and, by a wonderful contortion, got hold of some of these beads with its teeth and began cating them. he man opposite suddenly began smiling, and then he chuckled and slapped his knees, and felt very happy because the dress of the woman who stepped on his footwas in a fair way of being ruined. It was a family of nine, and they made a formidable =~ appearance as they marched on board the train. Fir: came the father. He was short and fat, with flowing side whiskenr: red face, and husky voice, He c d a two- year-old baby on his right arm, and led an interesting string of chubby young- sters with with his left hand. Toiling on behind was the fat man’s wife and the mother of all the children. A fretting baby was snuggled up to her bosom, and the mother and baby wheezed and fretted together, It was a frightfully hot day, and the family was going to Coney Island to cool off. Perspiration streamed from all their faces. The man cl ed a row of nine seats by requesting soveral p sons to sit somewhere else. The chi dren immediately stuck their heads out of the windows, while their mother and father mopped their facesand struggled to regain their breath. *If T had to work as hard as this in the store.” said the wman ir rumbling tone to himself, “*I'd kick like a bay steer, What a man suffers when he's enjoying himself nobody knows except the unfortunate man, If I ever get off another day it will be when there's a blizzard or a deluge howling around. Are you enjoyin’ yourself, Mary ?"’ This was said in_a loud tone to his wife, who laboriously nodded her head and said *0Oh, yes, I suppose so.” A florid, happy looking man got on board at Fifty-ninth street, and was very careful to sce that Lis three sons, who came racing in after him, w comfortably seated. The most rema able thing about the man and his boys was the fact that ench one of them car- ried and fondly cared for n handsomo bamboo fishing rod. The brakeman came inside the car and glanced long- ingly at the rods and a wicker basket that one of the boys carried, “We're goqu fishing,” said the man. “So I see,” said the brakeman. “Where aro tou golng?? “Gravesend beach. Get a boat there and anchor out in the bay. All my boys fish. I taught them how and made them fond of it. Why? Because a man who loves fishing is always contented. He never caros whother he ever gets rich ornot. All he wants is a bang-up fish- ing rod and a glistening reel. It ma soem funny to you, but it’s true. thorough fisherman is always hl\gny. No matter what trouble he has, let him go away fishing, and the trouble leaves his mind imwediately. I wanted my boys to be happy, and 80 I taught them m¥o\'e the sport. Now I feel that they are safe. Iam happy, m\)sl’ are happy, and nobody’s kicking. hen you feel discouraged try a day’s fishing and see how contented you'll be,” g e— Had a bilious attack and one of those indescribable cases of coustant weari- ness. Goodman Drug Co, DAILY BEE: FRIDAY, JULY 27 1888, The Limit of Spu Soribner’s Magazine for August: The speed of locomotives has not increased with their weight and size. There is a natural law which stands in the way of this. If we double the weight on the driving wheels, the adhesion and con- sequent capacity for drawing loads, is also doubled, Reasoning in an analo- gous way, it might be said that if we double the circumference of the wheels the distance that they will trayel in one revolution, and consequently the «poed of the engine will be in like pro- portion, But if this be done, it will require twice as much power to turn the larger wheels as was nocded for the small ones; and we then encounter the natural law that the resistance in- crenses a8 the square of the speed, and probably at even a grenter ratio at very high velocities. At sixty miles an hour the resistance of a train is four times as great s it is at thirty miles. That is, the pull on the draw-bar of the engine must be four times as great in the as it isin the other. But at sixty miles an hour this pull must be exerted for a given distance in half the time that it is at thi iles, so that the amount of power e. nd steam generated in a giv must be eight times s great in the one case as in the other. This means that the eapacity of the boiler, eylinder, and the other parts must be greater, with a corresponding additiou to the weight of the machine. Obviously, if the weight per wheel is imited, we soon reach a point at which the size of the driving- wheels and otier parts e )d of time sy which means th is a certain proportion of whecls, eylinders, and boiler which will give o maximum speed, A peculiarity of Hood's Sarsaparilla is that while it purifics the blood, it im- parts new vigor to every function of the body. Locomotives. ne for August: In 829 Mr. Horatio Allen, who had been in England the year hefore to lc 1 that could then be learned abou 1 locomo reported to the South Caro- ling ¢ company in favor of steam of horse power for that hine. is of that report, he says, ‘‘was on the broad ground that in the future there was no reason to_expect any ma- terial improvement in the breed of rses, while in my judgment, the man not living who knew what the breed of locomotives was to place at command.” As early as 1829 and 1830, Peter Coop- erexperimented with a little locomotive on the Baltimore & Ohio railroad. At a meeting of the master mechanics’as- i —at the institute which boears his namoe —he lated with great glee how on the trial trip he had beaten a gray horse, at- tached to another car. The undeveloped condition at that time of the art of machine construction is indicated by the fact that the flues of the boiler of this engine were made of gun-barrels, which were the only tubes that could then be obtained for the pur- DOSH The boiler itself is described as about the size of a flour 1. The whole machine was no ! than a hand-car of the present day. 3 In the same year that Poter Céoper built his engine, the South Carc Railway company had a locomotive. called the “‘Best Friend,” built at the West Point foundry for its line. In 1831 this company had another engine, the “*South Carolina,” which was designed by Mr. Horatio Allen, built at the same shop.
