Agard against the city of Omaha was concluded yesterday and after some delay in preparing a special form of blank verdict for the juryto fill out when they have arrived at an agreement in the case, they were sent to the jury room with the case. The plaintiff has sued the city for £5,000 damages for the death of her husband, caused by the dangerous condition of the sidewalk. The caso now before the court Dillard R, Fant agaiust Charles S. Lingoln to recover §4,000 on & promissory note. Lin- coln says Fant sold him about one hundred horses, taking therefor his promissory note, It was supposed by Lincoln at the time of the transfer that the horses were all sound, buthe shortly afterwards discovered that they were afflicted with the glanders. Abont forly-five of the animals have died with the disease and have communicated the i fection to a number of valuable horsos he had befora the purchase, eight of which have died. Lins coln thorefore refuses to pay the note and Fant brings action to recover, Distriot Court. There was only one case on trial during the forenoon. That was the case of George ‘W. Forbes against William and Thomas Ap- pleby. Tn this action plaintiff asks to have the defendants ejected from a piece of land they occupy in the western part of this county, about four miles from Waterloo. Plaintiff claims to hold a direct title for the land while the defendants hold a tax title to the property and claim absolute possession and ownership of the same from the fact that they have had possession of the property under their tax title for over of Mount et al against Stevenson that was on trial Thursday before Judge Hopewell and was con- tinued over until yesterday, was con- tinued until Monday, owing to the death of Mrs. Robert J. McConnell, daughter of C. T. Storrs, one of the jurors hearing the case. Judge Wakeley was occupied in writing some opinions that he will render to-da, in cases that he has had under ad- visement. Among them will bo the base ball injunction case and the case of Wright against Davis, Judge Groff was occupied in preparing some ints in cases that have been submitted to him. He will not hear any wmore oriminal cases before Monday. is that of NEW CASE: Nels Seirroe began an action for £650.40 in the district court yesterday against Tieno Ben- zon, August Benzon and Rupert Vieno to have them fulfill a contract for the construc- tion of the brick and masonry work on some residences. Josiah Milligan began suit against Henry Sanguinand others claiming $1,601.66 damages against them for failing to keep their cons tract in doing some building work for him. They were to complete the work and pay for all the material. The defendant claims they did not keep the paying part of their con- tract and a mechanics’ lien has been served on the buildings for the above amount. OF WHAT MILLIGAN COMPLAINS. Josiah Milligan represents that he paid Henry Sanguin, Guy Matteson, M. S. Lind- sey and J. H. Hulburt £5,340," the amount agreed upon for the erection and completion on St. Mary's avenue of two houses. Henow finds that they gave Gorman D. Wyatt a lien on the property for lumber amounting to $1,661.06, and by so0 doing tho plaintiff com- plains that he has suffered in that amount and asks judgment against the defendants. A $15,000 DAMAGE SUIT. Samuel Wallace alleges that while in the employ of the B. & M. in the capacity of a switchman on Scptember 14, 1887, a switch engine backed down on a flat-car on which he was standing and threw himoff. The wheels of the engine passed over his left foot, crush- ing it so badly that amputation iwas neces- " He is forty ycars of age, has two small children dependent upon him for uu!\port.mld isnow a cripple for life. The railroad, he insists, was to blame for the accident and he demands damages in the sum of $15,000, County Court. FORBES MUST SETTLE. The jury in the case of Forbes against Tinnon, in which plaintiff asked for $1,000 orrent due him, returned a vordict yes- terday for the defendant for $33.23, and held that the plaintiff shall pay the costs in the case. The defendant filed a cross-bill that more than off-set the landlord’s claim, and brought about the above verdict. SOME ONE 18 MISTAK The case of Frank Nance against C. F. Blazer was on trial yester- day. Nanco sold Blozer a team of horses for $255 that the latter claims he made a partial payment on. Nance claims that no payment was ever made on the team, and sues for the full selling price, APPOINTED EXECUTRIX. Mary Kaufmann was appointed executrix of the estate of H. Kaufmann, deceased. JROBINSON SUES LARKIN. ‘William H. Robinson claims that Edward Tarkin owes him §200 on a promissory note, with interest added, and he prays for a judg- ment in that sum. DUE OX MATERIAL, Welshans & McEwan complain of Emma H. Thayer that she owes them a balance of £308.40 for building supplies furnished. They sk for a judgment in that amount agawst ier. LEVY FAILED TO SETTLE. 1t is represented by Messrs, Marshall, Field & Co. that they supplied M. Levy with goods amounting to £325, which he has not paid. They would hke a judgment with ins terest and cost of suit added. PROMISSORY NOTE SUITS, Roberts, Thorp & Co ask judgments against John F. Rector, James Rector and J, Brokaw on the following promissory notes, with interest added: #86 from August 9, 1553; €30 from September 21, 1895, and §4: from August 9, 1583, A DAUGHTER'S DEMAND. Conrad Ochse had two wives before he passed to the realms beyond something like a year ago. By his first wife he hada danghter, now a resident of New York, and an_endowment insurance policy which he had on his life for 1,000 he left to his daughter when he made his will in 1880. The balance of his realty and personal ownings he bequeathed to his wife, but provious his death the policy matured and Ochse drew the $1,000, which he deposited in the bank, From time to time he drew on the fund, and when he was called to his long home omy a little over §500 remained on deposit. Over this state of affairs the daughter is very much perturbed, and yesterday through her attorney petitioned Judge Shields to have the balance made up by the estate. The judge took the petition under advisement, Without health life has no sunshine, ‘Who could be happy with dyspepsia, piles, low spirits, headache, ue or hisouscs of the stomach, liver or kide neys?
