A Blue-Blood Social Olub Plans an Exclusive Reception to Their New Bishop—Breeders Organize, [PROM THE BER'S LINCOLY BUREAT.] Among the decisions handed down yester day by the supreme court was a reversal opinion in the Boone county murder case rendered by Judge Roeese, and which gives the man Carr a new trial. The points raised ng opinion are of interest, es in their bearing on like murder trials been appealed to the court. It was A day yesterday with the entire court of re- versals, every decision filled being cases re versed from the judgment of the lower court. The decisions are as follows: Carr va State. Error from Boono county. Reversed. Opinion by Reese, Ch 1. On atrial for murder a witness for the state stated in detail the circumstances sur- rounding the tragedy immediately after the killing; that th sed was lying upon the ground and the accused standing near by With a gun in his hand, and that he very sooh walked away, carrying tho gun. He was then asked by the prosccuting attorney why he did not arrest, or assist in arresting, the nccused. Over the objection of the accused, the witness stated that the reason why he did not. attempt the arrcst was that he did not think it safe to follow him. Held, error. 2. As a goneral rule, threats made by the defendant prior to the murder, to kill or in- jure some other person than the deceased, @re not admissible as evidence ogainst him. 3. 1t is not error for the court Lo refuse to repeat an instruction to the jury already sub- stantially given, 4. The guilt of an accused is proven beyond a reasonable doubt, when upon the entire comparison and consideration of all the evi- dence the minds of the jurors are in that con- dition that they can say from the evidence, they have and feel an abiding convietion to a moral certainty of the truth of the charge. A reasonable doubt does not consist of possi- ble or conjectural doubts not growing out of tha evidence: but is one which, when con- sidering the evidence alone, leads the juror %0 hesitate, and upon which he would refuse to act in the important concerns of life. It is error to charge the ¢ that it is a doubt, for the having of which the juror can give a reason derived from the testimon 5, Whero a defendant is on trial upon an indictment charying hir with murder in the first degree, the couniy attorney having made the opening argument to the jury after the testimony is adduced, whether the coun- sel for the accused can cut off further arj ment by refusing to address the jury, quaere. 6. Every person accused of the commission of a crime is guaranteed a fair and impartial trial by the constitution. This right should be carefully protected by trial courts, and the conduct of attorneys and allothers which l;:'nvum such a trial, should not be permitted y the court in which such trial is had. 7. Malice—"A clear, concise and compre- hensive definition of legal ‘malice,’ though often attempted, has not been fully achieved. Approximately it is that condition of the mind which shows a heart regardless of social duty and fatally bent on mischief, the exist- ence of which condition is inferred from acts doune or words spoken.” Harris vs. State, 8 Tex. Where a writ is rcturnable on a day in rich the court is precluded from transuct- lug business, such writ will not be void, but thie rewurn day will bo the first day thered fier in which the court may legally transact busi- ness. 8. The statute declares certain days to be legal holidays, and closes the courts on such days, except, ¢te. Where a party has entered land under the homestead law of the United States and made final proof and compliod with the law on his part to entitle him to a patent, he may make a valid dedication of a portion of said Jand for a public road, although the patent has not been issued. 2. In that cliurch there is a little dancing club called the Cemus that evidently poises as the blue blood aristocracy of the Catholic church, and this clement Las planned a public tion to Bishop Bonacum, to be held at T hall next Monday evening, and the bishop, who is unacquainted with the mass of the Catholic comuunity here, has accepted the tender of the reception, which will evidently spread it on thick. But the great majority of the good Catholics in Lincoln do not enjoy the idea that a dancing club shall stand out as the only representative of the church in the city, and a great deal of feeling is ex- pressed already regarding the reception. The aristocratic clement has issued invitations to only a portion of the Catholics in the city, and has neglected entirely to invite some of the most prominent among hurch mem- bers, so that what ought to have been a grand united welcome to the bishop will be an_af- fair held by a feeble minori yin the church, BREEDERS ORGANIZ A number of broeders of draft horses in the state have held a meeting in this city and organized the Nebraska Draft Horse Breod- ers’ association. BOUND OV Steve King, the man arrested on election day for fraudulent voting, had his prelim- inary hearing yesterday and was bound over to answer m district court under $500 bonds, which he failed to give, and was taken to the county jail. King asa repeater was a suc- cess, voting several times in the different wards, and_probably more times than have been unearthed yet. He will be made an ex- ample of for the future in the city, and will undoubtedly serve a term in the pen. The Garbage Float and New Paving Blocks. Chairman Balcombe of the board of public works went down to the river yesterday at the request of the contractor who has been calking the dumping barges, to locate & ring-post for the purpose of mooring those essentials. The water had risen consider- ably during the night, and the bo: risen with it, threatening to bid an ui monious adieu to the anchorage, which has been the railroad track, and go on a trip down the stream. The boats are located at the foot of Davenport street and the expected rise in the river will probaoly t them floating above their old anchorage. Specimens of three kinds, of paving v ided yesterday evening to those already on exhibition at the office of the board of public One of these is a_cypress block, of no particular shape, which has_been placed on exhibition by J. C. Regan. It was upon this kind of wood that this contractor off bids & short time ago, at $1.50 per yard claimed that the sample is a soction of a tie which has been used in the ground for five years past by the horse railway com- pany of the city. Tho block seems to be about in as good a state of preservation as it was when it was first placed in the ground. A petition has alrcady been circulated in soveral parts of the city in_the interost of cypress, and that it has been selected by about eleven blocks of property owners on Leavenworth street. he vitrified paving block is another sam- ple, the name of the exhibitor, however, not being given. This is & little longer and wider than a brick, and seemingly of the samo material as sewer pipe and looking as if it had also undergone the same vitrifaction, One side there is a grove which is pressed out on the other into a convex ridge. The block is quite heavy and is intended to stand on end. It is intended to match with others making a very solid roadway. There is another brick on exhibition, which is intended for walks. It looks on the side like a loaf of “cream” bread while the sur- face has the appearance of a section of chocolate cuke. It is about twelve inches in length, four in hei and four in thickness. It is compact, w made and seemingly durable and has been placed on exhibition by McCague brothers of this city who are its manufacturers, Secratary Wappich says that there at least fifty applications per day at the ofic of the board of public works for work in paving or upon the sidewalks now in course of con- struction. It would seem as if there has been unusual influx of labor this year occa- sioned by the work of last season. The board will meet this afternoon at 1:30 o'clock to open bids for the construc- tion of the sewer in district forty, being that bounded by Seventeenth and Eighteenth and Charles streets.
