Bccretary Mason Explains the Situa- tion to the Inter-State Commis- slon—A Rich Find-The Wost- phalen Family—Brevities, PROM THE BEE'S LINCOLS BUREAU.] In the question of state jurisdiction over the Union Pacific railroad, argued a few days ago before Judge Dundy, Mr, C. O. Whedon, the attorney for the board of transportation, has supple- mented his argument with a brief that deals in very pointed facts in regard to the question. Among other things the brief recit that there is nothing in the charter of the Uuion Pacific which reserves to the United States the exclu- sive jurisdiction over the company or emancipates it from state control. There is in the charter no contract be- tween the general government and the corporation that it shall not be subject to the legislation of the st The state is not king to interfere with the reserved rights to the government, but the brief holds that the state has the power to regulate all its internal commerce and that is all it is seeking. A state is not sovereign without the to regulate its internal com- '0 the plea advanced that the act by which the rond was created reserves the right for congress to reduce the rates after certain earnings have been reached, the bricf says: This is a question of importance and per- manent concern to the state of Nebraska. The cost of the construction of the road is a natter of history, and if the allegations of the bill that the r tion of rates and con trol of the road by the state board of tr portation will bankrupt the compan true, nothing but extortion, of which history furnishes no parallel, will’ cnable the com- pany to reach the limit at which congress may reduce the rates. * * * Can it be that the federal government has called into a private corporation, i common r, whose rates for the transportation of persons and property it cannot regulate be- cause it has voluntarily deprived itself of his power, and that this act of deprivation also prohibits the state from regulalipg the rates! If it has accomplished these results, then this complaint is over and above the law; there is 1o power to prevent and punish extortion or unjust discrimination. The rates charged may be both unreasonable and un- ust, and there exists. no corrective power; or the wrong there is no remedy. The brief recites that the compl ant, the railroad, has not shown entitled to relief through a perm: injunction. It affirms that the state has the right and power to® regulate rates within the state citing the recent court decision to that effect. It cites that the state in the case is not seeking and does not attempt to regulate commerce at al it is only secking to regulate the instr ment of cemmerce. The principnl croditor of the company, the United States, says the briel makes no claim that it surety is in danger of being im- paired, s the attorneys of the roud at- tempted to show the court., Concluding his argument Mr. Whedon says: The railway company docs assert that it the board of transportation is permitted to proceed, it will be unable to pay the interest upon its funded and other debts. Its solici- o for tho rights of the government is what, remarkable; had it evinced it earlicr in itshistory the *“Thurman act” men- tioned [n the bl might not have been nece sary. The defendants disclaim all power and authority to regulate the rates between the states; they disclaim any intention of at- tempting to regulate the same. But, acting for the state, whose servants they are, they do insist upon the authority and’jurisdiction not only to require the change in the embank- ment mentioned, but also to fix and regulate rates within the state of Nebraska, and to dotermine what are just and reasonable rates. CONCERNING CAR LOAD RATES. Secretary Mason yesterday forwarded the following communication from the board of transportation. ToT. M.Cooley,Chairman Inter-State Com- mission, Washington, D. C.—We urgo the coutinuancoe of car load rates. Their aboli- tion will destroy the jobbing interests of the west. Our distributing hovscs at Omaha, Lincoln and Fremont ave of great benefit to the retail dealers of the state, affording them convenience and eredit. The present system of differential rates builds up trade centers within the state. A few years ago Peter Westphalen with his own family and that of his brother, moved to Kansas. Inthe Indian massacre which oceurred there, the brother and an un- married sister, with some other rela- tives were killed, Peter hastened back to Dodge county, but the trouble through which he had passed, added to the loss of his relatives, aflicted his mind and he committed suicide. The lumber interests and the anthracite coal interests of the city have determined upon separate presentations of their grievances in the matter of freight rates and their discrimination in faver of Chicago, and have instructed the freight bureau of the board of trade to at once prepare and for- ward a bill of complaint tothe inter-state commerce commission. Gas Inspector Gilbert says this rather remarkable occur- rence had its origin in & condensation of the carbon in the gas, which constitutes one of the most dangerous and flammable sub- sta es in the world. This condensation takes place during the passage of the gas from the cold underground pipes into the warm rooms and apartments of residences and stores.
