Attorney Hawley appeared (-)r the comvany and 1. Lambertson Iur the Lincoln fi it bureaun, I. M. mond, p ent of the board of trade, and J. E, Utt, secretary of the Lincoln freight burewn, were the witnesses, There were sonie yery serious charges of excessive rates brought out by Mr. Ray- mond’s testimony, he showing thatit was impossible for him to do business on the Elkhorn line owing to the local tarifls charged. ‘The testimony of Mr. Utt was of much interest, for he spoke by the card and was an equal expert on railrond ra The facts brougnt oat in Mr. Utt's _testimony showed that the rates on Nebraska roads were as beretofore charged imr ased since the age of the inter-st law. Mr. U d that since thy mm state state law had taken efiect that the rate on lumber had been raised 10 cents per 100 on both Omaha and Lincoln; that the former rate at Oma of 12 cents had been increased to 22 cents, and the former rate of 18 cents to Lincoln had n raised to 28 cents, Mr, Utt’s testi- y also showed the discrepaney that existed between the Omaha rate and the Lincoln rate when mileage was consid ered, Mr, Utt stated that from the best of his knowl: the city of Lincoln would pay fr 100 to $3500,000 more, at present rates, this year for freights + than it would have been obliged to pay a yeav ago under the ul(l rate, He testified “also that Yankton, had a less rate than Lincoln and it W.lh farther distant than the latter place from Chi- eago. Mr. Utt estimated that the amount of goods distributed from Nebraska wholesale points would be over double that distributed 1n Dakota. The cost of building and equipping their road and the new country argument, advanced vy the Blkhorn attorney, was ventilated by Mr. Utt's testimony on cost of construc- tion and operation of the Northwestern in the state. The question of net earnings was opened up and the filed statement of the road of 1ts net earnings for 1886 was placed in evidence, The ruvcrl_y cluim of the road was not estab- ished by the report in question.
