Topics and Services For the Church Goers—The Suit Over a Traveling Man’s Dishonored Draft—An Insurance Decision, Scheming For Fees Polk county is threatened with a new kink in the liquor cases, a scheme hav- ing been digcovered which may be tried in this and other counties as well, Itis claimed that attorneys are to be allowed under the law $5 for prosceuting each liguor case, and preparations are being made to open up about a thousand such ases in that county alone, which, at §) each, wonld net a nice little sum. In order to make the bonaunza still larger, the different cases are to be brought sep arately, ustead of having several counts in one information. Fhis would prove a great find for attorneys in any county, but there will be an attempt to head it oftby allowing only one sueh fee, instead of one for every count. The county at torney of Polk county has issued a eireu- Jar which exvlains #he situation !nlh Notice to Attorneys, Justices of the Peace, and Peace Officers of ‘Tolk County, Town.— Gentlemen:: 1 have been informed that there is a probability of certain persons causing to be instituted a large number of prosecutions against persons holding permits from the board of supervisors to ' sell intoxicating liquors, for separate illegal sales of intoxicat- ing ligliors, and that also that it is the pur- pose of those engaged in this scheme to_have each ease prosccited by an attorney ap- pointed by a peace officer, and an_attorney’s fee of $0 faxed agaiust Polkk connty i each case. | therefore deem it my duty as county attorney to call your attention to section 1,640 ot the code, as amended, and for the purpose of saving cxvense to the county, to urge that all prosecutions against the same person for separate illegal sales of_intoxicating liquors, be et forth in separate counts and embraced in - one inforwation, 1 shall advise the county in all cases where one per- son is proseciited in separate informa- tions for ‘illegal sales heretotore made, to allow the justices, constables and attorneys fees provided by Taw in only one o jsuch cases. L am also inclined to the opinion_ that versous holding permits, except registered pharmacists, cannot be prosecuted under section 1,540 of the code as amended, and 1 1 advise the board of supervisors not to atlow the fees in any Such cases unless the proof shows that the defendant did not hold i permit, unless he be a recistered pharma cist. 1wk the above sugzestion not for the purpose of preventing any legitimate prose- cution of violations ot the liquor law, but for the purpose of saving expenses to the coun- ty. it being apparent that such proposed pros- ceutions against the same man ean as well be prosecuted in one case as in a number of cases, | also make the suggestion in_order tiat persons interested in fees in_ such cases may not entertain erroneous ideas as to what fees the county will consider itself legally liable to pay. R. 1. BAYLIES, County’ Attorney, Polic county, lowa, - A Traveling Man's Draft. In the cuse of Groneweg & Shoentgen vs Kusworm, the jury after being out a day and a night returned a verdiet m favor of the plaintift for the full amount claimed. ‘The case was brought to re- cover the amount of a draft cashed b, the I known firm as an accommoda tion to the defenda: traveling man, as s often the case in business circles. The fivm had thus accommodated the travelin man on previous occusions, and the defendant had always hoaored the drafts. This particular draft was dishonored, however, the defendant claming that he had harged the traveling man a few days before the draft was made out. The] plainti imed that the defendant had by i miven Groneweg & Shoen to believe that' the mun was still their agent, authorized to draw on the house for traveling expenses, ete., and it was shown that the plaintifts had not been notified to the contrary by Kusworm.
