He asks thatan | order be issued requiring a contestant of a ease, after it has been sed upon by the Jocal land officers, to give notice of the con- test and have a trial hefore there can be a sus- pension of patent. Tle sks, also, that in future no title where a land ofticer's receipt has been given on agricubtural land, shall be suspendedor eancelled until a hearing is had before the Jocal land oftice, with a right to appeal to the land commissioner and seeretary of the in- terior, and that at sneh hi s dne notice must be given the parties interested by pu lication or otherwise: that upon the govern- ment in these trials must rest the burden of proving that the original decision of the local Jand oftice was obtained throngh fraud; that all entries on agricultural lands that have been suspended shall be removed ana placed on the same footing as eases arising after issuance of the order. Senator Edgerton says that while remedy in the courts may be ample, they are too expensive and operate oo slowly to mect the necessities of the peo- ple. Healso wants provision made for ihe protection of innocent purchasers of, or parties making loans upon lands, the title to which was ob- tained by frauds, He thinks an innocent purchaser of a mortgage should be allowed to enter the land on payment of double the minimum pri provided it has been shown that il settler has committed a frand in *“proving up” without a suflicient settlement on the land. He asks also that witmesses be compelled to attend the trials of contested cases, and has g hopes of having the rules moditied to me all of these suzgestions, Mr. Jenks Indi Ang his approval of then. THE DEMOCEATS AND DAKOTA. To-day Chairman 1ill, of the house commit- tee on territories, informed a delegation here from Dakota that his committee will hear, on next Wednesday. arguments on the Harrison bill to admit south Dakota to statelood, and organize north Dakota territory. Senators Edgerton and Moody, Representative Ka- nouse and Governor Mellette will speak, each one taking a distinet line of argu- ment. It is believed that the tacti the democrats in the house will employ to defeat adimission will be to propose to ad- mit the whole territory as one state, knowing that the people of the territory prefer to stay out rather than come in in that way. Then it is believed that it will be argued by the democrats that there isa division of senti- ment about statehood amonyg the eitizens of Dakota. Should this be brought forward the representatives from the territory now here will propose that congress pass an act con- firming the proceedings already taken for statehood, and admitting south Dakota under the Harrison bill, provided the people of the whole tertitory give a majority vote for it. They say the provisions of the Har- rison bill would be ratified by a vote of nine- tenths of the population.
