The report Is Intended to be supplementary to that lssued In April. RIGHT OF WAY. The Terms)of An Important :Ordi- nance Passed Tuesday Night. Some time since the Omaha Belt Rail- way company applied to the clty for cer- tain right of way privileges In the north- ern portion of ths city. Shortly after, the Omaha & Scuthwestern road filed re- quest that if the Belt rallway were to bo allowed right of way privilegee, that the same should baaccorded to them. Toavold any trouble, & meeting of the officlals of both roads with the couacil committee on streets and viaducts was held. The re. sult was the framing of an ordinance passed |Tuesday, the Important features of which are embodied below: “Be it ordered,that permission and authori- ty bo granted to the Omaha & Southwestern railroad company and aleo tothe Omaha Belt railway company, to lsy track * * * com. mencing at block 99 in the city of Omsha and running thence in a northwesterly dircotion to Uhicago street; upon and across Dodge street, through and acroes Eizhth street, Cap- itol avenue, Ninth street, Davenport streot, Tenth street and Chicago street; and also through, along and upon certain street running _northwesterly from the corner of Ninth and~ Davenport strzets to the corner of Tenth and Chicago streets, and being and lying along the west side of the tracks and right of way of the Ohicago, St, Paul, Minneapolis & Omaba, the raid Omaha & Southwestern Railroad com- pany to use and occupy the eastern portion thereof, aud the eaid ‘Omaha Belt Railway company to occupy the western portion thereof, the tracks of said companies to be looated'as the city engineer may direct, the rights and privileges granted herein not to interfare with the rights of said city by ordinance to grant the privilege to other railroad com- panies to construct, maintain and use tracks upon such portions of the streets and avenues notioccupied by the Omsha &} Southwestern Rallway company, or by the Omaha Belt Railway comoany, or to use upon just terms the tracks constructed by sald companies, or either of them aloog and across said strests and avenues,” This pormission iy granted upon con- dltion that these companies shall conform their tricks to grade and that they guarantee the city from all suits, or dam- sges arlsing out of the use and ocoupa- tion of theee streats and aveau:s, and that within two years they shall cons:ruct and operate and constantly maintain one ormore tracks along and over said streets to be ueed In connectlon with & regular line or system of rallroad, Absoclutely Pure This powder never varier.
