Wednesiay Morning, August 12, LOCAL BREVITIES. —~There were one hundred and five entries made for the Omaha fair at Secretary Wheel- ©:'s office yesterday. —A teologram was received from S, A. Me- ‘Whorter Monday announcing the death of his infant daughter Sunday morning at the home of his wife's parents at Decatur, Ill,, where Mr. and Mrs. McWhorter are now visiting. The body will bs buried to-day,and Mrs, McWhorter who is prosteated by the wshock will be taken to the north in the hope that a change of ssenery may restore her to health, At a meeting of the directors of the board of trade Monday the resignation of Secre: tary Thomas Gibson was received and lmd over., Mr, Gibson Is now in New York ata senitarium and will not bs able to return for wome time, and his son George Gibson, who has been acting as secretary for some time will not be able to continue his duties longer. The boy was the only support of hls mother who s In falling health and lives In a shanty on Nineteenth and Mason strests. The clroumstances of the boy’s dlsappearance ara the following: Towards the evening of 1ast Friday he w: playlng about the store of Helmrod & Co., 602 and 606 Thirteenth street, with his younger brother, elght years old. A farmer, somewhat under the influaence of llquor, Indaced the boy to go with him, promising that he would have nothing else to do but ride a horse and sell clgars and that he would earn seven dollars a week, which he could take home to his mother every Sunday. The boy has a lking for horses and hastened to sccept the generous offer. He got into the wagon and was driven off by the farmer up Thirteenth street, out of town. Who the farmer was and where helives, could not be aecertalned by the distracted mother. The only clue she has is, that the farmer loaded a barrel of mltat Heimpod’s, Upon Inquiry there she was informed that on that day Mr. H. M. Eby, whose postoffice is Bellevue, had bought a barrel of salt there Another boy who was present safd that the name of the farmer was Hill, Tho mother, who 18 tickly, unablo to worl, and dependent on her oldeat boy for support, is wellnigh crazy. She has applied to the police for help bat has been Informed, it is vnderstood, that nothing can be done for her. Receiver's Sale. WooLworrH, Recelver, ——— A Wifo Beater, Monday evening about 6 o clock, peo- ‘ple in the vicinity of Ninth and Farnam streets were startled by a successlon of a woman's scroams, lasulng from the house of John Fox, next to the Canfield. It was dlscovered that the lord of the house- hold, Fox, had coms home half full and had beaten his wife severaly, knocking her down and cutting her with some in-- strament. The pollce were sent for, but when they arrlved the brave man was nowhere to be found. Hls house waa thoroughly searched from top to bottom and at length the search was about to ba abandoned, when Fox was dlscovered crouching in a dark corner in his cellar, Ho was taken up to jail and this morn- ing, as his wife wonld not appear agalnst him, he was released upon payment of a fine of $5 and costs for being drunk, The police say that this man Fox s & ute. He has been known to beat his fe time and again, and onlya few eks 80 was sentenced to pay a fine of $26 and costs and to be Imprisoned for thirty daye, having been found guilty of boating his mother. Judge Dundy Orders the Smith Stock Into the Hands ot Receiver ‘Woolworth, Yesterday another Important step was taken In the Smith case, which has for the past two or three weeks been pending in the U. 8. tribunal, Court convened In the morning, Judge Dandy In the chalr, and after an exam natlon of the report of the fin- snclal condition of the sure- ties on Cole and Lowy’s bond, Mesers, Woodworth, Mills and Hanlon, Unlted States Marshal Blerbower decl- ded to accept the bond. The aitaching credltors, seelng that farther fight was useless, declded to mccept the secarity, and so notified the judge. After reviewing the circumstances of the case brlefly, Judge Dnndi lssued the followlng order, for the marshal to turn the goods over to the plaintiffs, Messrs. Cole and Lowy: This csuse coming on to be heard upon the exception of the defendants to the nufficiency of the suretles on the delivery bond taken and approved by the marshal, it 1s ordered that the said bond and the sureties thereon be approved, and that the marshal dellver the property in ques- tion to the plaintiff. And itls ordered and adjadged that the plaint{ff have and recover from said defendants the cost of this action from the filing of the excep- tlons to this date, to be taxed by the clerk. Ewver 8. Duxpy, Judge. Contlnuing he s “There iy a farther step which I have declded fo take. That is to order the recolver to take the goods from the plaintiffs, sell them, and turn the cash over Into the hands of the Unlted States clerk, 8o that it may be allowed to draw Interest during the subsequent litigation, Then the money will be turned over to the proper party or parties, so soon an the case s finally declded one way or the other.” The followlng order ~was made by the judge: This day this cause came on to be heard upon the order made by the court In the civll actlon of Lewls Cole, plaintiff, va. David W. Miller, pending in this court, for the dellvery of the property, which is the same property for which a receiver has been appointed heraln, to sald Lewis Cole, the respondent abova named. It 1s therefore ordered that upon the delly- ery of said property by sald marshal to said Cole, the recetver, C. D. Woolworth, appointed hereln, in pureuance of the terms of hls appointment, immediately take possession of eaid property and all thereof, and hold the same subject to the crder of the court, Said recelver ls heraby orderad to ad- vertlse for blds for sald property elther tn bulk or parcel, for cash or on approved eecarity, and submit the same to the court or judge thereof for further orders, Sald recelver Is further ordered to make a foll and complete Inventory of all property coming into his posseseion and file a copy thereof In this court. Ho 1s further ordered to take all necessary steps to guard, protect and care for the same untll farther order, by Insurance and otherwlse. Enmer S. Dunpy, Judge. Mr. C. D. Woolworth, the recelver, will inmedlately take ateps to secure the stock, and will follow out Judge Dundy's order, It has not been declded yet whether the sale will be a public or a privato one, whether cash payments only will be allowed, or whether time sales will be made. The money which will be realized, Judge Dundy ordered deposited in the Omaha Natlonal or the First Natlonal bank, The result of the examinatlon into the worldly wealth of Herman Lowy shows that he was the possessor of something like $300,000, in bonds and real estate. The probable wealth of Mr. Geo. S. Mills, one of the bondemen, was estim fed at $125,000, C. D. Woolworih’s wealth was estimsted at $50,000. He had no Indebtedness to speak of. Frauk P. Hanlon estimated his wealth as follows: 1n Citizens’ Bank of Stanton. Iu Nasional Bank, of Norfolk, Total. Adjolnlng the town site of Madlson he owns 320 acres of land; In Stanton coun- ty 320 acres, one-quartar section of which adjoins the town of Stanton; a house and lot in Omaha. Oan the first tract of land 1s & mortgage of $240, not dae uatll next April. This real estate, with the bank alougk, makes Hanlon’s wealth over $50,~ Judge Dandy, in commentlng upon the bond, remarked that he cousidered it good for at least £300,000, and had no hesitation In saylog that it would furnish ample security for $110,000, the amount required, At 2:30 yesterday afterncon Marshal Blerbower turned the property over to Cole, and elmultaneously Cole transforred it to Racelver Woolworth, Mr. Wooworth will immedlately proceed to take the inventory of the goods as orderad by Judge Dundy.
